Ok guys here is my first objection to their W/S.They are claiming I've denied being the Keeper of the vehicle. Well I've never denied that and I have never been asked my them. Is this their normal stand to lie?0
-
Huh? That seems nuts. Do you have a copy of your defence stating otherwise? or any appeal? It would be fun to show that they are either lying or merely incompetent...3
-
They have come back saying they did not have anyone reporting the machine faulty on the day
And this is relevant because? You have raised the matter. They must address it. The Beavis case was for an overstay in a free car park, yours was for an incomplete VRN, where are they similar?
Go through their WS and refurte everything with which you dis agree. If they have made false statrments they may be in contempt of court. You never know how far you can go until you go too far.1 -

Yes and I have gone through it like a tooth comb. There is no evidence I'm claiming or saying anything of the like.

If they have made false statrments they may be in contempt of court.Hi chap,They use the Beavis case to say a contract existed betweem them and I. I have countered that by saying the requirements for a contract in the Beavis case are none existant in my case. Such things as in Beavis there is an "Offer" and "Consideration" on the signs. However there is nothing of the sort in the signs at where I parked so therefore there cannot be a contract.Regarding the claims I have inclded the refutes in my W/S. If obvious their W/S is a copy and paste job and no solicitor has gone over it. Hopefully once I have highlighted this to the judge he or she will see through their smokescreen.1 -
Anyone know if the class action against HX Car Parking Management went ahead? This was driven by the former MP for Wokingham Sue Haywood.0
-
I think the term 'class action' is a USA phrase, and here it's a Group Litigation Order, which would need a solicitor to take it on and no, I've never heard of this happening.
Parking firms always say ''no-one reported a fault that day''.
I've NEVER, in over a decade of posting here and on other forums, seen a PPC admit that their machine was at fault. And the point is, if the PARKEON old machines are faulty and say, misread or ignore the first digit or something (yet still issue a PD machine ticket), then no-one would phone up to report a fault because no-one would know till the scam PCN arrived!
Be aware that they are trying to use smoke and mirrors to lead a Judge in the wrong direction and you are spot on, that their WS is a template cut & paste pile of crap!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I can't recall. Why not email the originator? Horse's mouth rather than forum hearsay. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I've just reread my defence and point 2 says I am claiming to be the Keeper of the Vehicle. Yet they are saying I'm denying that. Would they have receieved my defence?

The CCBC wrote and told you they were sending your Defence to the Claimant.
The Claimant then returned a Directions Questionnaire confirming their wish for the case to continue.2
