Hi guys,

I received a letter from the courts today informing me they have rescheduled my case for the 15th Spet 2020.

That's good, as long as it's not once again trying to corral you into a hearing on the papers!

Does it appear to be a face to face hearing?

Have you already filed your WS & evidence and received the other side's WS & evidence, ages ago?

If/when you are at the Exhibits stage, please post a copy of the alleged contract between the scammers and landowner for us to comment upon.

Received the following email from Gladstones today.
Dear Mr Bakedalasker
   We act for the Claimant.       In accordance with CPR 27.9 our Client hereby gives notice that it will not be attending the hearing on 15/09/2020.      Please note, our Client is unable to attend the above mentioned hearing and we have kindly requested that their attendance be excused and the hearing conducted in their absence pursuant to CPR 27.9.   We confirm the court has been informed and that we have asked the Court to decide the claim in our Client's absence based on the evidence submitted.

Does this mean HX will not be presented at all at the hearing?

It means they will not be there. It does not mean they will not be represented by Gladstones or a sub contractro of such. Standard fare

I replied to the email asking if anyone will represent thier client. This is the reply I have just received:

Dear Bakedalasker,

 

Thank you for your correspondence.  

 

I confirm no one will be attending for or on behalf of the Claimant.

So, you will have the floor, so to speak.  The difficulty there is, the JUDGE will sometimes read out the Claimant's case and then expect you to respond to him/her, which can be harder!
