You must have had an Order or Notice of Allocation previously, telling you that that MUST file & serve your WS not later than 14 days before any hearing?  That deadline still exists. It is NEVER just 48 hours before.  NEVER.   The 48 hrs is talking about the electronic version of what you have already filed & served in accordance with the previous Order telling you about the original deadline.

    As above.
Does it also say YOU file the bundle, or you have to submit to the claimant who also files
    ANd again
seriously suggest you reread your Allocation notice and comply with that. This order does NOT replace or negate that order. You will still have to deal with BOTH deadlines.
  • Thank you for the feedback.
Original notice of allocation to small claims track received in Jan had a hearing date for 20 April 2020 asking to file evidence no later than 14 days before.

Next correspondence was an email letter (around 8th April) which was General form of judgement ordering that the matter be adjourned to a date to be fixed.

Latest correspondence dated 11/08/2020 is a new notice of allocation saying hearing will take place on 14/09/2020.

It doesn’t mention the defendant filing an electronic bundle just the Claimant who needs to send to the court and other party 48hours before the hearing.

Please advise which deadline should I adhere to? 31st Aug? I emailed them on 14/06/220 asking them to advise when the final date is to file and serve my trial bundle and didn’t hear anything back.

Did you?  If not then the 14 days is still true.  But 14 days before the new hearing date (at the very latest!   Aim for a bit earlier).

6th April - 14 days before your scheduled 20th April hearing.

No I unfortunately didn’t as was ill for 3 weeks in March 2020 with COVID and by the time I was fully recovered I had already received the postponement letter. Shall I just file it to them now? Or wait till 30/31st Aug? Will I be penalised for a late submission now?

You are not late. I told you what your deadline now is, and it's obvious.

No, that's normal - read any other Gs threads!  You should have been expecting that.  ]

They might send a rep, just not the Claimant.

Please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    https://standardsdevelopment.bsigroup.com/projects/2020-00193#/section

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/913272/Code_Enforcement_Framework_consultation.pdf

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!
