I have another question - the costs that BW Legal list amount to £264.50.
If I lose - will I have to pay this AND the courts costs?
If so - does anyone know what the court costs may be (ballpark).
I’m thinking of biting the bullet...
How is that charge made up? I suspect they have added on some random amounts that they can't legally claim.0 -

After all the help that's been given by volunteers over the past 5 months? Just wow ..... !Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Umkomaas - I completely understand your sentiment and please let me assure you:
I am eternally grateful for the support of this forum and it’s users.
I am still totally determined to take this all the way.
However I also have a baby on the way and if I was to lose and the court orders the claimants’ costs to be paid plus £1500 in court fees (I’m guessing) - I will be in serious financial trouble.
Don’t get me wrong - I am 99% confident that I am in the right and should NOT pay, that’s what I wanted to ask if there was any idea of the cost *should I lose*.0 -
Answer the question as to the breakdown of costs and the total claimed
If they are claiming say £264 , then that is the total claimed , no more
The total claimed by the claimant was on your claim form
You would object to all the added costs under abuse of process
A typical loss in Court for one PCN is less than £200 if argued correctly
Umkomaas has posted the typical costs breakdown numerous times0 -

How much reading of (lost) court cases have you been looking at in the 5 months you've been with us? Not one I'd suggest.
Cost of losing:
£100 - original parking charge
£50 - (capped claimant's legal costs for filing the claim)
£25 - court filing fee
£25 - court hearing fee
£x - a bit of interest from date of parking event.
No more than a couple of hundred quid (give or take).

Not true
Premier Park are the claimant , not B w legal0 -
RedX and Umkomaas - I’m sorry. I feel I may be panicking and need to take a breath. With all the letters from BW legal in front of me promising added costs from the court if I lose I’ve evidently got scared and panicked a bit.
Umkomaas - please believe me: I have read so so many of the threads on both MSE and Peppipoo, and done a lot of research I think my head is a bit too busy and I forgot that I will only need to pay what they have claimed in total. Thank you very much for clarifying!0 -

Nice level headed, considered and pragmatic response. Some posters simply see their @$$ and go off on a rant against those genuinely trying to help them.

Thanks Umkomaas.
I am nearly finished with my Witness Statement, and will post, but as mentioned above before my mini-freak-out: I fully understand if there is no time to offer pointers. I also note your signature and understand that too.0 -
bear in mind its not just the WS
its the WS + Exhibits + Cost Schedule
dont forget to add the abuse of process paragraphs to the Exhibits , plus the CRA 2015 relevant parts too
read the monkeynuts45 thread, the CEC16 thread and the Abuse of Process thread too0
