    The not available dates should have been in your DQ !!

    Speak to the court and cite medical reasons for a new date

    Nobody on here can assist in changing it

    The alternative is have it heard on papers , telling the court and claimant some 18 days prior to the court hearing date , especially for non attendance
  • Thanks RedX - sorry I didn’t make it very clear - when I said “despite listing” - that was what I put on the DQ: the 9 days in Feb that fell on the due date.

    Send a letter to the Judge who ordered that date and ask for it to be moved to March and show evidence of why you are asking for this. Send the letter this week and copy in the Claimant's solicitors as well, by emailing them a copy for info.

    4 days either side is not enough!

    Indeed it is. If they were confident they wouldn't reduce the amount this far away.

    I would ignore BW Legal's template letter.

    More important is to write again to the Court Manager, if they didn't reply to your urgent contact 3 weeks ago about moving the hearing date and reminding them that this week was part of the non-available dates listed in your N180 form so you believe this is an oversight by the court, and cannot change things because your wife is due to give birth in Feb, hence the N180 dates showing as unavailable.

  • Thanks Coupon mad - they said when I sent the letter that they would contact me in a month. I’m going to call the court or drop in next week if I haven’t heard.

    Got the Witness statement from Claiment today.
    Interestingly it reads exactly like a defence of my defence, i.e: an argument, which I remember user:Loadsofchildren saying was not it’s purpose... it sets out every point of my defence and refutes/denies it.
    One interesting error they have made that I wanted to ask you all about:
    Throughout the defence they repeatedly state that I am “an employee of the managing agent” that manages the freehold.
    I am not - and was not. I was an employee of the estate agent that rented the spaces from that managing agent.
    Will this error give me any mileage at all? Or is that a lost cause...
    Surely a blunder like that that is not factual undermines their credibility...
  • They have also provided an email from the managing agent of the freehold to PP that “proves” that I was fully aware that permits had to be displayed. I would of course never have seen this email.
