You state both
You state "the defendant assumes, given the lack of any detaill, that this has to do with..." thus making it clear they failed to specify a cause of action.0 -
Thanks, most helpful. The PCN states that my ticket was not affixed to the windscreen and was face down on the dash and hence a charge was issued against me.0

What's the Issued Date of your claim form, top right?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

20th November. I’ve already returned the acknowledgment and have collated multiple resources from here and elsewhere to form a defence and witness statement in due course.0

With a Claim Issue Date of 20th November, and having done the Acknowledgment of Service in a timely manner, you have until 4pm on Monday 23rd December 2019 to file your Defence.
That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence could be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
1 - Sign it and date it.

Thanks Keith, much appreciate the timeline. I’ll start going through the process pretty soon to get my defence organised.1

Hi all, just finalising my defence and there’s one aspect I’d appreciate an opinion on.
My dispute is with Armtrac Security who have the following statement on their signage and also used it to overturn my appeal:
‘Retrospective authority to park will not be accepted’
Surely, by the term stated any appeal is a waste of time and no evidence is acceptable. Does this fit the law regarding appeals to PPCs?1 -
Ok, so many months later, about 15 I got my court date, but due to Covid I couldn’t attend. I really wanted to have my brief say, but not possible. Anyway, court met to hear my case last Friday. Short headline.
I WON!!!
Case dismissed
thanks is to all those that have contributed to help people like me. Don’t give up, be prepared to lose, but fight if you think you have a case. I did and I won.Cheers.5 -

Court location?
Judge's name?
Paper/phone hearing ?
Reason given by Judge for the dismissal of the claim?
Were Armtrac represented at the hearing?
Did you have any costs awarded to you?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
