Parking Eye Appeal Response...Want Driver Details ?

Apologies if I’m in the wrong place but I need help!
I sent an online appeal to Parking Eye a few weeks ago and they’ve come back saying that the appeal has been referred for further information because I failed to give driver details. I’m not sure what I should do next...if I ignore it does the appeal not get processed? I appealed as RK.
Back story is that our little boy was an inpatient in hospital for two weeks. I was told by ward that car reg details would taken for relatives and emailed to PE to cover the car for the duration of the stay, but they obviously failed to do this. The hospital will accept no blame for this as they do it “as a favour” when I called them to query this after the PCN came through. I feel these are mitigating circumstances and emailed PE with the appeal and attached admission note with dates, consultant signature etc as proof.
I’m just stuck as to what happens next. They’ve mentioned nothing about considering the appeal further regardless of whether I supply this Driver Detail info. Will the appeal still be reviewed if I don’t bother to respond?
Thanks

    Await a popla code

(Expect the appeal to be rejected - mitigation doesn't work with ppcs!)

    Keep on at the hospital!!

Maybe your local paper will be interested in this

Complain to PALS and insist that the PCN is cancelled, should have been done weeks ago

Remind them of the NHS guidelines regarding their responsibilities and yes they are to blame and are legally responsible under those guidelines

Check if the NTK met pofa or not

Edit your post to remove any hint of who was driving, blabbing online can cost you money

Complain to your local MP by email

    Which hospital ?

Do nothing, and await the POPLA code.

Double check your PCN (the first letter) as it sounds like it has nothing about the POFA 2012 on the back?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    google it

    https://www.nhs.uk/common-health-questions/nhs-services-and-treatments/what-is-pals-patient-advice-and-liaison-service/#

contact PALS at the UHW asap and get it cancelled

    NHS guidelines

    https://www.gov.uk/government/publications/nhs-patient-visitor-and-staff-car-parking-principles/nhs-patient-visitor-and-staff-car-parking-principles

and also get that NTK checked for POFA compliance (or not)

and Edit your first post above to remove any hint of who was driving, blabbing online can cost you money , you still have not done it despite earlier warnings

any mitigating circumstances are for PALS, not for Parking Eye and not for POPLA either

and enlist the support of your MP as they are obviously trying to scam you.

Nine out of ten of these so called breaches of contract are scams, and many breach NHS guidelines.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

Until this is done you should still complain to your MP, citing the new legislation.

If PE are asking for driver details, I strongly suspect (as already headlined by Redx and Coupon-mad) that they have issued a non compliant NtK.

If you can't work this out for yourself @OP, post a link to a scan/photo of both sides of the NtK (redacted of identifying detail, but leave dates showing) and let us see it. If it's non compliant, this is an easy win for you.

NEWBIES - HOW TO UPLOAD LINKS TO PHOTOS/SCANS TO MSE

To upload a photo/scan link, you first need to host it on a free photo hosting site (like Dropbox or Imgur), copy the URL, paste it here, but change the http to hxxp and we'll do the conversion. Newbies can't directly upload links to photos/scans until they've a few posts under their belt.

Please do not use TinyPic or PhotoBucket as they drop all sorts of gratuitous and unsolicited dross on computer screens when their links are opened.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Please, please edit your original post.
The DRIVER committed the alleged offence on the day whilst the KEEPER has received the NTK.

Be careful how you phrase your comments - you don’t want to snatch defeat from the jaws of victory.

PPCs only want your money so mitigation is a waste of time.
