    I paid £113

    Personally there is no way at all I would have thrown away a £113 item without phoning PayPal to confirm that they definitely wanted you to, Although I am unclear from your account definitely was a no fault return , i.e. Seller did not lose their funds, or not.

    I'm not quite sure where you go with this one now. Personally just keep copies of everything including postage receipts where you tried to return and if seller takes you to small claims defend it on the basis you did as much as you thought you could. If seller has had funds returned and is not out of pocket then he has no claim against the item anyway.

    However, I'm sure you can appreciate that this won't look clear cut at all. First a false INR claim (looking at this as an outsider might) , then you get a refund and then when seller tries to return,claim the goods they have been conveniently thrown away.

  • I did speak to PayPal and they advised the case was now closed and I no further action was required by me. He told me (by way of a message and screenshot of an email from Paypal) that due to the unique circumstances of the case they would refund him (they didn’t tell me this - on the claim it states they found in my favour).

    I’ve asked him to contact PayPal and he hasn’t contacted me back.

    I threw it away as that was the end of it as far as I am concerned as we’d both had our money back.

    Have you done anything wrong? Not according to your account of Paypal and their instruction.

    But, legally....if the seller is out of pocket they may well pursue you for the loss and win. It's a big if and a bigger may.
  • I think I’ve sorted it now, spoke to him via email and Paypal have told him that they should have refunded him but didn’t due to an error.

    Hopefully he will get his money back and that’s the end of it.
