Hello,
Just want some info on a PCN a friend got. (First PCN)
The driver parked on a private car park and went for an interview. He then looked for a pay machine but couldn't see one around. so he paid by phone (Which it states you can do) by the sign opposite the car park on the other side of the path. he went to his interview, came back and found a PCN on my window. As the driver had only being driving 3-4 years, he didn't realise the difference with a PCN and a normal GOV ticket so he appealed the PCN online (with his address, which he now knows is stupid...). They have rejected his appeal stating - "The signs at the car park make it clear that the land is private property and that a charge of £100 will be levied if vehicles park outside terms and conditions. The signs make it clear that a valid ticket must be displayed and purchased in the vehicle. The vehicle was observered parking whilst not correctly displaying a ticket". " We note your comments that you paid for parking via the telephone pay sign opposite, however, we must advise that this is not valid for the area you parked in"
They have said its £60 if paid by the 12th or £100 after that. Otherwise, it will result in debt recovery action being taken (Which he dont want to happen).
he can appeal to the IAS but wants to know his chances of getting away with it or trying to waive the PCN as £60 is quite alot to him.

No chance of "getting away with it' or "getting it waived", the IAS is a kangaroo court don't waste your time, and debt recovery (you have not got a debt) is a joke we laugh at on here.
You should be far more clued up after 3-4 years driving, but you are where you are, you now need to get clued up by reading the newbies thread on here to get to grips with this scam.

is right.
That does not mean you have to pay anything.
You do not owe anybody anything until a County Court Judge tells you so.
The PPC may not even bother taking you to court.
At this stage they are just scary letters.0 -
I've interpreted your comments as if you can send one email to the PPC and they'll "waive" it as a gesture of good-will. There is more chance of hell freezing over.
If you're willing to challenge this PCN, then sit back, read everything and be willing to learn. This isn't something you're going to solve within an hour. It's going to take some work, but the people on this forum will be willing to help you, but they will not spoon-feed you the answers (especially when all the answers are already available in the NEWBIES thread that Keith has kindly provided you).0 -

Not by the parking firm or the IAS. It will take a Judge to waive it.
Which parking firm? Then we can give you some idea about the direction this might take.
