I am really sorry that this has happened to you too. The child I have let down by buying a counterfiet ds has autism. It has been very hard to explain to him that he is not going to get the ds he chose. This is the only gift he was going to get . After alot of correspondence it looks very unlikely that i will recieve any compensation. I hope it will be very different for you. I wish you all the very best and a very merry christmas.0

I have also recieved a letter from HM Revenue and customs saying my ds console has been seized bevause it's dangerous. I've emailed gadget asia and still waiting for a reply. I have also opened a dispute resolution with paypal as someone said I am insured with paypal because I have not recieved the item. I've been told I could wait a while but I will eventually get my money back whether it is from gadget asia or through paypal due to me claiming. Is this true?0

I am no expert on these things but I have never seen on any forums or reviews that one of these has been dangerous - In fact we have had one for a year without problems and you can always just buy another charger from UK stores. Gullible if you have received yours you should perhaps hang on to it ;o)0

I am hoping we have some grounds to appeal if they are confiscated as it is a 5 year olds christmas present, as this was not cheap (£160.00 with postage and insurance), a substantial gift on our budget and in line with high street prices apart from the games bundle and we thought they would be largely discontinued or inferior games anyway.
We will see when we get the letter...
I dont see how it being a present for a 5 year old is grounds for an appeal of seizure.
You mention a games bundle, and given that I've been keeping an eye on gadget asia's site for a few weeks it would appear the only games bundles they did, with ds', actually came with an r4ds/dstt preloaded with downloaded games, and, as previously stated, every package I have seen has been under and miss declared. which oddly enough gadget asia has now re-worded the section on their site about declerations, which could lead to issues of compensation they are now claiming that they will only compensate you to the value of the goods declared.
The issue with dodgy chargers is a trading standards issue and they have acted accordingly.
all the best

r4ds/dstt preloaded with downloaded gamesquote]
Ta Phatbear, you seem to be right amongst this. My partner would not have known (or me for that matter) what r4ds/dstt was!??? But we both now understand what the games were but only after the media campaign and after Jo had ordered the device.
I am hoping the grounds might be for admitting the illegality, of which there is no question, but asking for return as Jo was not aware of this fact and did not know of these scams or have a good understanding of the product and only buying online for the first time this year.
The website looked very legit to the unaware and there is no protection to the consumer in these circumstances.0 -

Hi all
I thought I'd post again after a break to enjoy Xmas... really sorry to see that others have had similar bad experiences.
I've received a letter from customs confirming the DS Lite I ordered was counterfeit. On the same day I got a letter from Fed Ex (couriers) - an invoice from them for £13.55 as they apparently paid customs the duty on it.
I also got an email from GA saying they would reimburse but I would need to send the customs letter to them.
I've sent gadget asia a ticket and tried to attach these docs but without success. I''ve therefore taken Gullible's advice and emailed this Mr Yeung guy - at least I managed to attach the attachments! Thanks Gullible. I think I'm going to have to pay Fedex the duty they forked out on my behalf but I have asked GA to reimburse me this. Not holding my breath, but in my view they should be covering all costs, so I need to ask anyway...
In response to peggypip, I paid through paypal too. I'm going to try getting comp through GA 1st as I would guess they will require you to try. But paypal's another option I'll follow if I don't get any joy.
I'll post again to let you all know how it goes.
Finally, apologies, Gullible as I think you sent me a message but I can't seem to access it (new to this site and also a bit technophobic at best of times!!!) Anyway, will try again to see if I can read it. By the way, how come you gave up hope of getting a refund?
Best wishes to you all and good luck if you're pursuing a claim.

Hi New Martin Lewis Convert,
Paypal have a strict time limit which for me had run out. I think it is 45 days so if you haven't contacted them you should do so, even if it is just to notify them.0 -
Many thanks for that, Gullible. I didn't know that so I've lodged a dispute with paypal this morning.
Although Gadget Asia confirmed that they would give me a refund on or before 15.1.09 (this was in a reply they sent on 1.1) there's still nothing showing on my paypal account. I've sent another ticket which they responded to within 20 minutes, saying it would take another 3-4 days (though they didn't say why).
I'm feeling frutstrated at the timeframe, but still quite hopeful that I'll get a refund. Are there any others out there who were in a similar situation and got their refund? I feel like I need to hear a success story!New Martin Lewis convert :beer:0 -
Just to let you all know. I have received my refund on the 21.1.09. Paypal has refunded the money back onto my credit card. I checked today. It took a couple of days to show up.
You have to keep up the dialogue with gadget asia and if you have to keep opening tickets do this.
I did not receive my money in the 7-14 days they advised so i went through their ticket system and asked them when I will receive it.
They told me i would receive it on the 21.1.09 and it was in my paypal account on that day. So don 't give up hope.0
