Parking charge and admin fee from hire company

  • Just a quick (disappointing) update. With 2 days to go until the 28 day deadline and despite involvement from my local MP, both appeals have been rejected.

    Reasons are:

    Clear signage.
    The overstay beyond 15 minutes (despite me pleading that 15 mins isn’t long enough to load and unload furniture).
    That their phone number is clearly on the signs for us to call and query.

    They’re offering the reduced fine still if we pay within 14 days.

    Looks like they have us over a barrel. I really don’t want to go to court (and it seems like a few of them lately on this forum have gone in favour of the company).

    I’m so disappointed and absolutely livid.

    It's an IPC company. You were never going to win an appeal. That's a given. What it has done now is flag you as a difficult target who can fight back.

    It discourages court action if they think you may very well win.
  • I have written to the property management company (as UKCPM are saying I should have received permission to park there but they are denying all responsibility) and my MP again in the hope they can help me. I really can’t face court or the increased costs so this is my last attempt. I am so angry I might have to pay up but don’t see a choice!!!

    If they add on costs you can ask the court to throw the whole case out as an abuse of process. It's been done and is now included in the Newbies thread.

    They aren't allowed to do it.
  • It’s two fines, at the moment it’s reduced costs for both if I pay now, this almost doubles if it goes to court, plus costs.

    They aren't fines, they are speculative invoices. If it comes to court, you ask the court to combine the two cases and you should only be stuck with one lot of costs IF you lost. See this post (not the same as yours but it shows about combining cases).
  • Thank you. Unfortunately it’s still doubling the amount, if I pay now it’s reduced. I’m really conflicted...
  • Just an update for you all. After multiple letters to property management company, estate agents, landowner and finally the car park attendant I received this today.

    I am writing to inform you that the above parking charge notice has now been cancelled as a gesture of goodwill.
