Parking Fine for Unloading

Forget about who booked you, the shopping centre exists to get as many members of the paying public using their facilities, in addition there will be contractors serving them, their tenants, and the hirers of their facilities.
It makes no sense for them to be awkward about all this and it's them that engaged these scam artists to pretend to control their parking, so they can stop the Muppets from victimising legitimate visitors.
Maybe they will help, maybe they won't, some are interested in their business and its future in a difficult e commerce environment, some are short sighted, who knows.
In the meantime do some research about what happens if they don't come up trumps about fighting a small claim in the county court.
There's loads of info on here in past posts and in the newbies thread.
But if you think paying a scam is what you want to do it's your choice, but you will only be contributing to the PPC's next BMW or villa in Spain.0 -
Shopping centre (The Forte, Birmingham) have now told me that as I parked on yellow hatched lines and I shouldn’t have they could not reverse the decision. It’s the same as if I parked in a disabled parking bay and not being disabled. I’ve now spoken with solicitor friend who says If it goes to court, I’d lose, because they’ve got photographic evidence of me there, even though only 7 minutes. It’s not worth the risk, just pay the £60 as the bill would be in the hundreds then. As you’ve said there’s no use appealing and I don’t understand what other Defence I’d have, as I’ve got no evidence in my favour. I will have to do this. This is a massive shopping complex not a small piece of private property we’re window sticker fines are placed.
If I understood how I could proceed I would, but I just don’t, nothing I’ve read tells me that they can’t take me to court. I’ll get debt collectors after me, letter after letter, then court. I don’t see how it can go any different.1 -

An awful lot of PPC's huff and puff but never go to court. Even those that do go to court don't take everyone to court. Before they do launch a court claim they are legally obliged to send you a letter notifying you that they ARE (not may or recommend) taking you to court.
Why not wait and see if you get such a letter? There is nothing to gain by not waiting.
I also disagree with your solicitor friend about the odds of you winning. I think you have an eminently winnable case as you were instructed to park where you did. The yellow lines have no legal significance on private land.0 -
Once again a cryptic reply with no help what so ever. Just go away and find out for your self. As I’ve said nothing hear tells me clearly what to expect in language I can understand. It’s all a riddle for me. There’s no guarantee I’d win at all. Unless you believe so but I’ve spoken to a friend who lost his case to a company like this after following advice on a forum like this. Dangerous I believe. You’re not legally trained.or are you?0

Yellow hatched lines have zero meaning on private land. NONE.
You werent parked
You were unloaidng
The two are legally distinct. If in doubt, try parking on double yellow lines on the public highway vs unloading / loading there.
Are you at all aware of "litigation risk"? NOONE can say *with certainty* what a court will say, because a court can entirely make up its own mind whatever way they like.
If youre not happy with t he quality of the free advice, which -= if you had read some completed court cases you would see - has resulted in people winning loading /unloading cases before, then your refund cheque is in the post0 -

What was cryptic about it? You are asking people to predict the future. Nobody can do that.
The parking company might never issue a claim. There again they might. If they are going to they will tell you.
Do you understand that?0 -
Instructed by a member of the public, as I’ve stated before, not a member of the shopping centre staff, or the venue staff. Apparently there is a unloading bay at back of centre. I’ve explained I didn’t know, but they say it was up to me to find out. Signs are up saying all unloading at back but I never saw them. My solicitor friend said in cases where a disabled person was fined for being late etc, they can fight on grounds they could get back quick enough because of disablement and fight on this. They do tend to not go after these sorts of cases. If it had been a member of staff telling me, then it would be dropped but it wasn’t. NOT EVERY CASE IS THE SAME as stated else were. That is just incorrect and Mr Lewis should alter this and take more interest what is being said here. Maybe I’m stupid but I’m just not into legal things and can’t see a clear answer anywhere just maybes,,perhaps, fingers crossed etc.0

You didn't answer my question. Do you understand that many parking companies never go to court?
If they intend taking you to court they will send you a legal document telling you. A warning so to speak.
As you are struggling I'm trying to break this down into chunks you can understand and not move on until you do.0 -
Forums are supposed to be helpful places were folks give you info to help you not keep telling you to go find stuff out yourself. If you know why not tell me. I’ve been up hours and hours searching for info that will say 100% they can’t take you court, if they do they won’t win and certainly no one would ever state that every case is the same. So if you don’t want to help don’t bother putting comments like this down.nosferatu1001 wrote: »Read, and understand, the newbies thread.
If you want to know if THIS firm tries court, you need to do some research yourself.0 -

I'm trying to tell you but you seem to be ignoring me.0
