That is often enough for victims to pay.
Don't know why you cannot see that, as that is exactly what is happening with you at the moment - you are considering paying simply because you have been threatened with court action.0 -

OMG, the regulars are telling you that parking companies can basically do what they want as people are more than likely to pay what they say - either through ignorance/fear etc and you are now getting rude which the regulars will not like

It’s just one big joke to you lot isn’t it. I said signs WERE up, I DIDNT SEE THE SIGNS because I could not see the venue, soft play area, which turned out to be inside the centre, so after much dashing around trying to spot it, I called was directed in and as I was running late, just unloaded and parked my car.
My only grudge is that I was told it was fine to park there but can’t prove it. You need evidence for a proceed in a court case. I’ve looked this up and if I can’t bring any witness statements or supply any evidence I’ll be laughed out of court.

But no one here knows my case. They are basing everything on the fact that if I know what I’m doing let them take me to court. But I don’t know what to do if I let them. Not a clue. Got know evidence, they have. How can you go to court and fight, if it comes to that, with out any evidence. What do I say they were on Watch Dog they are certified Rogue Traders.
I get the fact that they don’t take everyone to court and I might get lucky but if not I’m stuck. I wouldn’t know how to defend my self.0 -
What are you going on about, I know you said you didn't see them - I am agreeing with you that they were NOT CLEAR, this is a 1 good defence for you to use

I parked on a yellow hatched area on a bend in a shopping centre car park for 7 minutes. Now facing a fine.
Someone told me it was ok, can’t contact that person now.
Sign right by where I parked.
They have a loading / unloading bay else where. I wasn’t told by person who booked this, but as it’s a private party (member public) it’s not the centre or venues fault.
How do I fight this if it goes to court. What defence do I put up. If you can answer this I promise I won’t pay.0 -
Magi2009, I've not posted on this board previously but I post on other parts of the forum and I often read threads on this board solely because I so admire the depth of knowledge and commitment some of the regular posters have. They're not a bunch of amateurs. Honestly, they're probably a world authority on how to challenge something like this and I'm certain they really will do all they can to help you but as has been said, they're just too stretched to lead you through the entire process.
I can see you're (understandably) finding this whole situation immensely stressful and daunting - I would too (whereas to the forum gurus your situation is par for the course)- but because of that, I think you're getting yourself into a bit of a panic (again understandable) and therefore finding it impossible to see the wood for the trees. May I make a suggestion? Step back, take some deep breaths, get yourself a pot of tea (or a bottle of wine or both) and (slowly) read through the Newbies thread. Doesn't matter if it takes you a few goes (there's such a lot to take in) but I think that if you can do that you'll see that most (if not all) of the questions and concerns you've raised are answered (illustrated with examples and success stories from other forum users past and present) and that it isn't as complicated and definitely not as scary as it seems at present. If there's someone who can read through everything with you it might also be a help (I find it really makes a difference when you're in that state where you've forgotten the start of the sentence by the time you reach the end).
Hope this doesn't sound horribly patronizing but I can see you're struggling and I think that if you could just allow yourself to relax and come down from the ceiling you'll see that you can challenge this (with every prospect of success). Just think how (rightly) pleased and proud of yourself you'll be then!0 -

Grace periods. All parking companies are expected to give 10 minutes grace period.
Vine. If signs aren't seen you can't be held to them.
Forbidding contract. If a contract specifically forbids something then it can't ask you to pay for something you can't do ie if it says No Parking then it means exactly that. It needs to make an offer you can understand ie parking in hatched area costs £100.
Informed loading was acceptable. If someone told you why should you disbelieve it? Yes this point has legs in law.
Lack of POFA compliance. I bet the NTK has flaws. I've only seen one or two that haven't.
I will also bet the signage isn't actually compliant. Both the BPA and IPC sign off none compliant signage.
Is that enough?0
