    So, the CST law letter before claim has come through today. Funny, I don't recall ever receiving their SAR reply. Which I'll remind them of. Just ignore this letter and wait for official court papers? 
    Do not ignore a Letter Before Claim.
    The first few paragraphs of the second post on the NEWBIES thread explains exactly how you should react upon receipt of a Letter Before Claim.

    There is a reply form but no option to email. Is it best to send  by post with proof of sending, but not signed for? 
    Sections to respond to: 
    Do you owe the debt? 
    How will you pay? 
    Do you intend to get debt advice? 
    What documents are you sending? 
    I received a SAR back in September from the PPC. Also, requested SAR from CST Law but received nothing. Is it worth pushing this point in reply, as well as asking for evidence of the ability to charge additional £60 on top of the max penalty fee of £100 per PCN? Total debt = £320

    So my understanding is request SAR from PPC, which I did previously back in September. So, therefore write an email to CST Law:
    (a) I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.
    (b) I have sent your client a SAR
    (c) also confirm your correct 'address for service' if you've moved and the PPC has two addresses.

    If you've previously sent a SAR to the PPC in September, is there likely to be any new/other information you suspect they now have?  PPCs can charge for subsequent SARs which essentially relate to the same information already supplied. As far as I know there are no hard and fast rules as to what justifies a charge, but it's best you are aware of the possibility.

    Good to know, thank you for pointing that out. My plan therefore, is reply to put the claim on hold for 30 days. Remind the solicitor of the SAR request they have not responded to and prepare for the next steps.

    Will also attempt another landowner cancellation and involve the local MP.

    As the liability was transferred to the driver, is now a time to introduce the permit for another vehicle that entitled them to park there for work?

    RE: Letter Before Claim – Dated XXXXXXXX

     

    Dear Sir/Madam

    In relation to the above Letter Before Claim dated XXXXXXXXXX.

     

    1.     I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.

    2.     I also request that you provide a copy of the contract you allege between me and Debt Recovery Plus, to whom CST Law are asking me to pay £XXXX

    3.     I request that you confirm why you are asking me to pay Debt Recovery Plus when you state that you are acting on behalf of the claimant Anchor Security Services Ltd T/A Care Parking

    4.     I also request that you provide an explanation and breakdown of the additional £60 per PCN, when I understand the maximum penalty is £100 per PCN?

    5.     I refer you to the SAR request I issued to CST Law on XXXXXXXX, this was not returned to me in 30 days as stipulated by the Data Protection Act 2018 and to date has still not been returned. I now request that you provide the information requested or I will have no alternative but to make an official complaint to the ICO for breach of the Data Protection Act 2018 by CST Law.

    I request that you provide confirmation of receipt of the above, in line with the 30 day deadline stated in your Letter Before Claim of XXXXXXXXXX
