  • Response received from PPC regarding SAR (request made 7th August). Apparently there's going to be a delay due to the pandemic and workload. To be worked on in a month's time. 

    Are there any changes to ICO timelines of a month, under current situation?

    Apparently they're going to be nice and ask the debt collectors to stop making contact during this time. How kind.

    Check the ICO website, but as far as I'm aware, the existing laws/acts/timescales regarding an SAR response are unaffected. You can could tell the scammers now that you expect the response to your SAR in one month or you will report them to the ICO, or tell them in a month's time they have missed the deadline and you have complained to the ICO. Sup chew, as long as you do make a complaint if they miss the deadline.
    The scammer's workload is not your problem and is after all of their own making. They gave the motorist deadlines and historically have never extended them no matter what. 
    The ADR Act 2015 actually states that access to alternative dispute resolution should be available for not less that a twelve month. You could tell them you will only allow a delay to your SAR request if they provide you with a PoPLA code.

    On first glance it appears not. Most websites have a Covid-19 announcement banner to reflect impact on timescales etc, so remains the same as far as I can see.
    Will consider the options. Requesting a POPLA code for a delayed SAR, now there's an idea. Could it still be acceptable to complain to ICO as well if there's an informal agreement there - or should I say contract? 😉

    I take it this would have to be if they don't meet the deadline to provide the data they hold, not beforehand? The suggestion from @Fruitcake of sending a response to the PPC saying the data must be provided within one month or complaint to ICO, or any delay is subject to the provision of a POPLA code seems tempting.

    Yep, if they miss the 30 days deadline, calc from the day you served them, you are free to sue them.

    Would this be a further breach, advising another party to not provide contact during this time? SAR went to DRP and CST Law too, so potentially no response from them within ICO timescales either.

    Parking companies are sticking to the time limits on their signs, no extensions because of covid, so they dont get a free pass where the law is concerned either

    POFA (the law) still applies, like the 14 day rule for a postal NTK , the GDPR law still applies, as in the 30 day rule , not complying with the law is their problem, not yours

    they could just cancel the outstanding charges and close the case off !!! that would negate it somewhat
