Though the more familiar I become with this scam, the more justified righteous indignation seems. If the same happened to me now I think I'd get in first with a request for free cinema tickets to offset my 'admin'.0 -
Update:
I still recieved a county court business centre letter, but will revisit the cinema manager too.
In the meantime I am writing my defence response and have this so far. I have read the newbies thread many times but I'm personally struggling do would appreciate advice.
The defendant denies that the claimant is entitled relief of the sum claimed, for the following reasons.
1. The defendant entered their registration number into the maching at the cinema.
2. The defendant has proof of online ticket purchase for a movie correlating with time and duration of parking.
3. The cinema manager asked Parkingeye to cancel the parking charge.
4. The time and duration indicated on correspondence from Popla was incorrect.
What amendments could I make to this?

With a Claim Issue Date of 11th June, you have until Monday 1st July to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. Having done the AoS, you have until 4pm on Monday 15th July 2019 to file your Defence.
That's almost three weeks away. Loads of time to produce a perfect Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

Send a SAR to the Cinema, refer to the GDPR and ask for a copy of the email they sent to ParkingEye.The duty manager requested a cancellation of notice there and then without even asking me for my evidence. He said I should receive a letter of confirmation within 28 days, so fingers crossed!
That will either flush out:
- that the cinema failed to send one, or
- that ParkingEye ignored an instruction from the cinema, pre-court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi. My claim form has been returned because I didn't submit my defense.
I have read through the newbies thread many times but can't find anything I can use for reference in relation to my circumstances.
Can anybody please help?

Why did you submit a claim form?
You did the Ack. of Service online, surely?
You have until 15th July to submit your defnce. You knew this TWO WEEKS AGO and you still dont have a defence written?!

Your claim form has been returned from where? Did you post it or use the MCOL service to do the AoS? It is not normal to send a defence with the claim form but to submit it as per KeithP's post # 26.0
