BW Legal / Premier Park Limited - parking charge notice - 4 years old

  • Thank you. I have just taken another look at post #2, but I have already previously put in a SAR request and that I'm seeking debt advice.

    They agreed to place the file on hold until 19th June (14 days).

    I sent them another email on 15th June outlining the reasons why the PCN is not valid.

    They acknowledged this in September 2019, asked for my updated postal address but now have received the 2nd letter of claim.

    What part (SAR request / debt advise / dispute) would you suggest using when replying to this claim again?

    Well, if they can't work out the fact that they've already issued one LoC, and then issue a further one, I'd give them both barrels by seeking the same data/information/suspension of action again.

    If you believe it will only delay any action, is it worth at this point trying to formally defend this?

    It won't sop them, what makes you think that anything will stop them at this stage?

  • Hello,

    I have now received a third "letter of claim" all related to the same PCN.

    1st - 29/04/2019
    2nd - 07/11/2019
    3rd - 12/12/2019

    I responded to the 1st and 2nd letter, informing them of their clients inability to hold me liable under POFA2012. I also explained that there is a breach of PAP for debt claims, and stated I will complaint to SRA about mishandling of my data.

    They replied stating -

    Thank you for your recent email, the contents of which have been noted on file.

    We can confirm that all your points raised have been responded to accordingly.

    You have stated that Our Client has confirmed that you were permitted to park in the car park on the date of contravention, please provide this evidence so that we can look into the matter further.

    I also provided them with a document from the land owner, stating the vehicle was allowed to be parked at the time the ticket was issued.

    Your position has been noted however Our Clients Position still stands.

    Please note that the evidence provided is irrelvant to the matter, although 2 hours free parking may be permitted you must enter your vehicle registration in the gym in order for this to apply and be added to a whitelist.

    Pleasr fine cnlosed signagewhich supports the matter.

    Their attached image of the parking signage is from March 2014, but the PCN is from May 2015?

    I have asked them to raise this as a formal complaint so I can escalate to SRA.

    Anything else I should do?

  • Not really, it is surprisingly consistent!
    I've just received another one dated 09/03/2020 (making this the 4th one).

    I submitted a formal complaint, got a reply on 21/02/2020 where they said the one sent on 12/12/2019 was an administrative error, but the other ones were sent correctly.

    Do I need to reply to this one again, considering I have responded to the previous ones?
