Good luck for tomorrow, hope all goes well and you teach those scumbags a lesson.
  • Hi,

I handed it into the court on Wednesday and sent 1st class to VCS too.
And well tomorrow is the day! I am slightly nervous but I think I've got this in the bag, confident in my case, just nervous at nature!

Thank you U414830 for your interest and help. I will let you all know tomorrow the outcome!

Take proof of posting the WS and costs schedule, in case they pretend they didn't get them. PPCs often try that. And take a wage slip as proof of lost income/leave.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hello everyone,
I am glad to say that today was a success! :j
I won the case and was allowed £85 in costs.
I am going to do a write up now but the Judge wrote up his Judgement and sent me (and VCS' rep) away with a copy to 'share with whoever' as he put it.
you can find this linked here:

So I arrived at the court at 9:30, my listing was at 10am. The usher told us we were last on the list so ended up waiting till about 11:20, a long wait but I felt confident. VCS' rep came over about 10 minutes before asking me questions about stuff in my WS.
He asked me where i got the 'Master Plan' from that @LoadsofChildren helped me draw up, he seemed on edge about that. He also asked if i had anything else to add before we went in, and if so, to tell him first.
Obviously I politely said I think its best to wait until we get into the room which he nicely accepted and walked away,(but also partly because my mum might have scared him off hehe).

The initial hearing lasted about 8 minutes in total. The Judge explained the process for me as I said I had never been through something like this before, and then the Rep said his piece. The judge asked him lots of questions, mainly around the point of the signs wording and how a customer could acquire a permit if the business was closed. He wasn't amused that the rep had nothing to offer around his questions.
He then asked if i had anything to add that wasn't already in my witness statement and, since I didn't, I said no but that i did want to put emphasis on the wording of the signs and how i believed they were misleading and prohibitive

He asked us to wait outside for around 30 mins while he made his decision and that he wanted to write up his judgement for us today. We went back in, he read it and then awarded me my costs (which big thanks to Coupon-Mad, if you hadn't of told me to bring a payslip yesterday, I probably wouldn't have been awarded it)

From the first 5 minutes of the first hearing, it was obvious he had already made his decision. He was clearly fed up with the fact that this was his 3rd or 4th case for that same car park for the same reasons. He made it clear to the rep he would not appreciate seeing anymore cases in that car park, for the reasons they held against me and to 'pass that on' to VCS as it were.

I can't thank you people enough for all the help and reassurance you've provided me with. I probably would have broke and given in a long time ago but I am so glad I didn't.

Massive thanks to Coupon-Mad for that brilliant defence you made for me, Loads of Children for really perfecting my WS and giving it those extra touches it needed, and to the rest of you who pointed out those typos and explained the things I didn't understand!

    Well done, excellent result.

The judgment is very detailed, I wonder, whether the Judge has dealt with other VCS/Bounce cases, and he had most of this ready typed up as a template? Because 30 minutes to think through and then type up his judgment is a pretty quick turnaround.

Major monkey off your back. Thanks for the feedback. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Congratulations, great result!

Would it be ok for me to use your judgment sheet as an exhibit in my own case?
I can omit personal information like your name from the docs, you should probably edit that from the link you posted though

DJ wrote some very persuasive lines on the £60 charges being unrecoverable so I'd really like to parrot that in my own WS

    Again, great job today!!
