DRP & Eurocarparks

So I've received this letter from Debt Recovery Plus stating that I owe them 140 pounds from a car park charge that I by the way, never received.

These letters are dating that it was done in 2017.

Now I understand that ready the sticky, making an appeal and all this, but like I said, the charge (that I never received) has now been passed onto this debt collection agency who are sending threats saying "We will recommend our client takes you to court".

What's my best course of action? Ignore this letting? Call them and explain what I've done here?

I don't want these people putting ccj's on my file as I've seen that happen before. Would I be correct in saying they'd need to actually notify me of a court date before such things could happen?

What a mess these companies really are.

    Hey buddy, yes I did ignore (so far) as per the advice from yourself.

    I'm actually wondering though that since I do not have this vehicle anymore and that it's not registered to me, would it be possible I miss a legitimate court claim? That's something I do not want to happen.

    I'm a lady but am a buddy to newbies here, I suppose! :D

    The fact you sold the car is irrelevant. A PPC can't ask the DVLA for the current keeper.

    You are correct - but even more than that...

    You cannot get a CCJ 'on your file' until all of the following have happened:

    1) you have received a County Court Claim.

    2) if you ignore that Claim you will receive a CCJ in due course.

    3) if you Defend that Claim and lose in court, and fail to pay the amount the judge orders in the stated timescale, then you will receiva CCJ 'on your file'.

    You are entirely in control on whether a CCJ remains on your file for six years.


    Follow the guidance offered and you will never receive a CCJ - guaranteed.

    Thanks guy's and gals! So as of now I am ignoring DRP. Would I be correct in saying that they clearly have my address (even though I do not own the accused vehicle anymore), so I do not need to do anything else in terms of updating anyone with my address in-case of a court claim letter?

    Last question, I promise lol.

    P.S, I am in Scotland (Not sure if that makes a difference).
  • it has to be asked , have you moved house since date of origional ticket , as the DRP letter may be a "trace" letter , and with no reply , the parking co will go ahead and issue a claim at old address

    I moved house the very same month of the accused parking date. I do believe the information on my license and V5 was still registered to my old address at the date of this 30/11/2017.

    I assume I need to be updating someone or moving forward further to find out information about this?
  • well you are in a funny situation , england/wales I would suggest telling parking co your new address

    wait for others to comment , ad you have now reveled you reside in scotland , and laws are different there

    Have you now updated both (separate notifications) with the DVLA? If not, they can issue some rather tasty penalties (up to £1,000), so if it’s not already notified - do it soonest.

    Yes, that is correct. I am still within Scotland.

    I updated it back then after a month or two of moving, however, I've sold the car and now have a new vehicle at my current address.

    That being said, I believe eurocarparks are still in belief that I still live at my old address which is worrying me as I don't know what to do moving forward. This would explain why I have not received the actual original charge in my opinion.
