Help my car has been Towed away on Private Land

    But the reason for all that is because you were dealing with a scammer, this should have been reported to the police you have been stitched up.

    You should report the private towing to the Police as a crime,

    You should sue

    Elite has acted illegally by towing the car

    Hang on everybody, slow down. I suspect that this has nothing to do with legitimate parking. I read somewhere that if a car is abandoned or causing an obstruction on private property, if the landowner complies with certain conditions, it can remove a car from its land.

    I very much doubt that a HA which has 80,000 customers would not be aware of the law, and suspect that the OP has brought this upon themself by ignoring the T&C of their lease.

    The HA must know about POFA2012 and the rules Elite must follow

    I don’t think that this is the case.

    Firstly abandoned vehicles can only be removed by the local council not by the landowner. The landowner has to report the abandoned car to the council who then place a notice on the car warning of imminent removal. Then it’s the council who removes the car.

    Secondly the OP reports that he had to pay several outstanding parking charges before the PPC would release the car.

    Perhaps. However I believe that if vehicles are obstructing emergency vehicles a different rule applies.
    You never know how far you can go until you go too far.

    That is my understanding

    Elite have no jurisdiction to tow a car as they are not an authority

    I did report to the police, I also went to the police station, the police checked the system and said my vehicle is with Elite management, and that it wasn't stolen, that it is a civil matter, I showed the police pofa2012, the police woman said , I should take them to court that, they can't get involved because it is a civil matter. I also went to citiźen advice bureau, they called them to release my car, and the end the call on them, and we kept trying the phone number again, and they didn't pick up, and citiźen advice ask me to go home and keep trying them. and I should be firm with them to release my car. And they didn't pick up the phone anymore. I have got them on recording..I will be taking them to court but I want to get my record straight on how to file a court case against them

    I think services such as the fire brigade can move a car with force but not tow it away
