I can't figure out how they came to say it's £55 owed. Surely it's a full months carers element to be added again

That was my instinct. The full carer element applied to the assessment period in which the change took place. The only thing I could think was that possibly ther was an adjustment for Carer’s Allowance received that had not previously been taken into account. However if they had already taken the CA into account it should be the full carer element.

OP you need to ask DWP how they have arrived at £55.12. Ideally you want a revised calculation for the January - February period which you can then compare with the original one.

Thanks calcotti I'll get onto them about it and ask for a revised calculation

I got sick notes off Dr yesterday
Got a copy of the old one dated Jan 17 - Mar 17 and got a new one dated Mar 18 - May 17

Added the dates to my UC and have an appointment to take them into my local jobcentre today

Women on the phone said to ask the person who checks the sick notes to refer my wife for the WCA and that they should then send a questionnaire out in the post

How does the WCA work exactly? Does it get backdated to a certain date?

Calcotti How do you do what you did in your last message were you quoted what I said and added it before you messaged me back

The bit before you type your message it has my message and says originally posted by houndog6105

How do you do that? I can't seem to figure it out

Go to the message you want to quote and click the Quote button underneath it. It then appears in a reply box that you can add your comments to.

Unfortunately the WCA is not backdated. The extra money will only be payable , if awarded, from 3 months after you provided the Fit Notes.

The WCA is similar to the PIP assessment but it has different criteria. During the assessment she'll be asked about how her conditions affect her ability to do any type of work. She will need to answer all the questions herself, unless you're her appointee and then you'll be able to answer them on her behalf.

Once a decision is made if she's given LCWRA then the extra £328 will be paid from the 4th month of the claim, starting from when you sent in her first sick/fit note. There's a 3 month waiting period and because UC is paid in arrears it's from the 4th month. If it takes longer than this for a decision then she'll be backdated any money owed.

If she's given LCW there will be no extra money per month because her claim started after April 2017.

LCWRA better explained here (Support Group ESA is exactly the same as LCWRA)

If none of those apply then reg 35 may apply (substantial risk) Explained here.

    Thankyou

Our claim for UC started before April 2017 but we was just receiving WTC as we was both working back then

The circumstances changed in November 2017

So would these dates be taken into account?

No because her claim for LCW started after the changes took place.

Sorry but I don’t follow this. You say the UC claim started in April 2018 but you were just getting WTC. Any WTC would have ended as soon as you claimed UC.

However, regardless, the 3 month assessment period for getting additional money due to LCWRA, if applicable, starts from when you notify DWP of the change if circumstances. Although you have not yet provided Fit Notes you may be able to argue that because you presumably keep the DWP informed about her stay in hospital and her condition when she was discharged that they should have started a WCA sooner.

However a WCA could not be started before 2nd February because her earnings are above the earnings threshold, the award of PIP removes this threshold. The earliest date the assessment period could have started is therefore 2nd February.
