If your wife's accident was in December she's received PIP extremely quickly

As far as I'm aware your GP shouldn't, and is unlikely to, issue 2 fit notes at once. It's your wife's responsibility to show it to the employer and provide a copy for them and then give the original to the DWP. A duplicate is only issuable if the first is lost https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/464395/fit-note-patients-employees-guidance-sept-2015.pdf

Your wife will only be placed in the LCWRA group (the one that increases UC payment) if she's assessed as meeting its criteria,

Have you declared your a carer on your UC account?

Unfortunately even though CA is in payment they will not award the carer premium until its declared and verified on UC.

When claiming UC you have a work coach. I'm very surprised she hasn't been asked for a sick note. Both links will explain everything you need to know, please read them.

Reason that fit note requirement does not come up on UC system, is that employment earnings data for SSP is being received. Earnings above a certain level will block the Work Capability Assessment (WCA) referral process from starting.

If fit notes are reported on the UC claim online report a change page, then these can be taken to the Job Centre and the Work Coach can arrange for the Case Manager to request for a WCA. If a health condition is not terminal, UC normally waits about a month before making the WCA referral, but given the delays in finding out correct process, perhaps ask for WCA referral to be made straightaway.

In regard to Carers element, you would have to report the change on UC claim online. This asks you to confirm that you care for your partner for at least 35 hours per week. If your partner is in receipt of PIP daily care or enhanced care and nobody else is claiming carers allowance to care for your partner, then UC will add the carers element.

The other issue is whether the housing is correct. Do you have the correct bedroom entitlement ? Is the housing through a private landlord or housing association ?
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    Hi TomTom256

Yes I declared I'm in receipt of carers allowance and you can see from this month's award notice that they have included my £256 carers allowance as received income for myself this month

If your wife is receiving SSP then your Uc claim you should receive a work allowance ( the amount that is disregarded before earnings reduce your award) so maybe check this is also being applied. You should receive it until her SSP ends after 28 weeks. As others have said she needs to hand in sick notes and wait for a work capability assessment. if her SSP is paid weekly then the amount of Uc your receive monthly may vary depending if four or five of her paydays fall within your assessment period. it may be that in your last assessment period it was five and therefore that is why your Uc is particulary low. . carers allowance is deducted from your Uc at the rate of £279 per month as they average it out over the year. Sorry I just re-read your post and can see you are getting the work allowance. The award looks correct apart from the missing carers element.
  • Hello huckster

I've informed them that I'm claiming carers allowance and they have included it to this month's award so they have definitely updated it at there end that I'm in receipt of carers allowance yet I've not received the carers element to my award for this month

As for the sick notes. I sent a sick note in December to my local jobcentre for the dates of 17th Dec to 17th Jan 2019. I didn't send a sick note to them for 17th Jan to 17th Mar as I only received a duplicate sick note from the doctors which I had to send to my wife's employer. Therefore I didn't have a second sick note for my local jobcentre. I did add it to my journal and I do have screenshot of it but I think they ask for the original copy but her employer has that.

As with renting it's private and it's a 3 bedroom and I believe we are entitled to a 2 bedroom only

However my wifes condition makes her unable to go upstairs and she uses the living room as her bedroom so I told UC and they refused me the additional bedroom

I have appealed that decision about 2 weeks ago

You must make sure there is no breaks in sick notes, they usually send you a message to remind you when it is running out. is there any chance you can get a back dated one for the period you haven't sent it in?

I can't believe that with all the advisors I've spoken to over the telephone with universal credit has ever mentioned that to me even after explaining our current circumstances nobody told me that I have to give sick notes in to anybody at the jobcentre.
You said here that you didn't know that sick notes needed to be sent yet you sent one for Dec/Jan.... Your wife needs to continue to send them until she's assessed for LCW.

  • I can't get hold of another sick note for them for the dates of 17th Jan - 17th Mar as I gave the duplicate copy from the doctors to work
  • Hi Poppy

Yes I just checked my journal and noticed I sent one back in December. My mistake
