A witness (nor evidence) can't be sprung on the Claimant at trial.

No, there won't be anything sprung on the Claimant. What will be mentioned and discussed is what they're already aware of.

But have you and that witness, filed & served your WS and evidence?

No. Due to an error on my part witness statements were not filed. No witness will be called and I will only refer to what has been entered already to both the court and the Claimant.
!!!! up undoubtedly but I can't change it; just be an example to others of what not to do

Oh dear. Best of luck, just relying on a defence and no evidence and no second witness.

Thanks. Yes it may be a challenge but as I said, if I serve as an example to others then there's help elsewhere.
The witness statement would have offered little more than the defence in any case and their own WS and evidence gives me things to work with.
Lesson to heed.

Out and a free man.

The judge was NOT happy with VCS and their rep as he couldn't expand at all on their witness statement. He gratuitously allowed me to present the bank statement I didn't put in any witness statements but had included in my original defence and long story short, VCS clocked up with their signage and the inherent entrapment (his word) by the dual PPC on the land. Because they were arguing contract not trespass he couldn't find in any other way than for me and dismissed the whole case with a flea in the ear for VCS... again.
