    You're right play them at their own game, I'm going to wait until tomorrow's post and if not received I'll phone again then start proceedings against them.

    Latest lies from Vcs, original cheque that didn't arrive (never posted) was being cancelled and second cheque was being posted.

    Phoned again for explanation why second hasn't arrived and now I've been told that the director has to cancel a cheque before another can be posted out.

    He said its not on the system if its been cancelled yet.

  • So finally today I have received my cheque for costs, should have been paid on the 23rd August.

    It took two phone calls and an email threatening to issue a warrant of control N323.

  • Thanks, when I phoned the court they couldn't advise the best route to take but went through the different options available.

    The reason I held back from completing the N323 form was because if on the day I filed it to the court and paid £110 then received the cheque that same day I'd lose the £110.

    The court did however mention emailing Vcs to let them know I intended to issue the warrant of control and that the email could be used as evidence should I need it, I cc'd the court in on the email.

    Send them an invoice for the interest at 8%, it will cost them more than that to process it.
    You never know how far you can go until you go too far.
  • You're right I should invoice them cos they were charging me 8 per cent, well trying to.

    Eighteen months in total but well worth it, I wouldn't hesitate to do it all again.
  • I dont think you can invoice for interest, unless the amount was over 5k.
