Help please there taking me to court

Hello, Ive received a county court claim form issue date 22 feb 2019 claimant is jd parking and gladstones are the solicitors. please can someone help me as to what to do next, there are many factors in this and the other parking charges ive received from this company which i can go into if needed i can dedicate tonight and all tomorrow on this. This is really stressing me out as i know its not legitimate and never thought it would come to this they have also lied on the claim form ill attach with my details obscured if required,many thanks

    With a Claim Issue Date of 22nd February, you have until Wednesday 13th March to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Wednesday 27th March 2019 to file your Defence.

    That's over a month away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    please can someone help me as to what to do next,
    Read the NEWBIES thread 2nd post, do the AOS as shown in pictures there, and show us your draft defence based on all the others (if unsure, adapt bargepole's concise defence).

    No need to show us the claim form, we see these every day, and win almost all cases.

  • Many thanks so i've just been checking and this particular notice i've realised i rightly or not paid a company called private parking appeals to deal with this for me i emailed them all corrispondances and letters of autherisation to deal with this for me so should i contact them or is it time to fight for myself. The lie on the claim form is The driver of the vehicle agreed to pay the PCN within 28 days of issue yet failed to do so. I would love to see the evidence that a im driver and b i agreed to pay. i have asked for S A R for all details relating to myself and vehicle and will now do the A O S.

    Jeez...was your Google broken? Look them up on TRUSTPILOT...not just the reviews, but also the banner warning note from Truspilot about them, and the company's ''replies''...

    So, what did that notorious (embarrassing for me) company do for your money then? How much did you throw at that?

    I would suggest that your money was wasted and you need to deal with this as if that other system had never been used


    so personally I would be following the advice on this forum, do the SAR, do the AOS and start drafting your defence, same as everyone else

    They are saying that by parking there the driver agreed to the terms and conditions of parking displayed on the signs.

    Have a close look at the small print on the signs. Do they say something like "failure to comply with the rules means the driver agrees to pay £nn within 28 days"?

    OH DEAR ...... you really should have searched properly

    Why not ask them for the result you paid for ???
    Ask them for a refund as they have not provided the service
    Get your credit card company/bank to reverse the charge.
    Report them to Trading Standards

    This set up claims they will sue people who instruct their bank to chargeback. Then you see what ACTION FRAUD has to say
