    You are missing the point, this is not about the BPA CoP.

    If they say the signs near your car said X but you can prove it was a completely different sign, saying Y, then the entire case can collapse.

    They can't say 'the contract terms looked like this' if they didn't.

  • "It is the driver's responsibilty to check for signage,check the legality before leaving their vehicle"

    Considering this isnt possible given lack of signs where vehicle was parked,or maybe the driver did check for signs and not seeing any wasnt in breach of any? Or shoudl I just concentrate on lack of signage in general.

    Yes that's very good.

    Link it in your WS, and for the hearing, take a tablet or laptop to play it if the Judge allows, as it is short, won't take up much time, and is good evidence of the lack of signs all along the tree side etc.

    Just a thought,what happenes if the Judge askes who was driving ,at the hearing? Do I have to tell them and what happens if I do?

    If you know who was driving, you must answer
    If you are unsure who was driving, then state you are unsure. If presesent, then state it could be anyone of - then list all the possibilities
