  • Hi, just wondered if you got any further with this? We’re in a similar position... no car, £7k down, 2 high court writs against Cherrywood Cars and Cherrywood Cars Midland. It’s so infuriating!

    We are unfortunately in the same situation.
    Purchased a Citreon DS3 in September, within five days in needed a new battery. Two days later i broke down on a busy dual carriageway, the police had to come as it was unsafe and we had to be towed back to Redditch as the engine was knackered. After 3 weeks of being fobbed off, we asked for our money back. They agreed when myself and dad turned up there and said it would take two weeks. Two weeks later, no sign of a refund but had a letter from a solicitor saying I had caused the engine to break as i drove it around with no fluid (despite it apparently coming with an MOT and full service the day i got it).
    Luckily we paid by credit card, so we started a Section 75 claim that got rejected as my mom had put it on hers but i was the only user. Had another letter from their solicitors saying that the company was forced to seize trading after not paying the high court and my car would be siezed and sold at auction. I rang the enforcement agents who said it will remain property of theirs as i rejected the car, but I wouldnt get my money back as cherrywood are going into liquidation. Credit Card Company said we could pursue a visa charge back, but without having proof of liquidation our time is running out!
    Any advice?

    Have you tried hiring a tracing agent? They aren't hugely expensive.

    I thought I'd Google CW to see if they'd closed yet and found this post. Not only did they sell us a complete heap of a car, they {Edited by Forum Team}!

    When we gave the car back for them to repair (they didn't repair just kept it for weeks until we asked for it back!) they watched us remove a laptop, satnav, ipod and car stereo and place it in the boot of the car we'd part exchanged for the lemon that we were getting back whilst they fixed the lemon.

    Stupidly I left it all in the boot overnight, not the brightest thing I've done but it's a pretty decent area and not had trouble before. Next morning car had been broken into and everything gone from the boot.

    When we finally gave up with them and left a review the {Edited by Forum Team} put in his reponse the location of the car when it was done over, it was something like, "sorry your car was broken into whilst at the back of your house", joke is, we never said where it was parked, he added that bit himself, if it wasn't them then how did he know where it was parked? {Edited by Forum Team} :rotfl: Glad they've shut :j
