    Does the OP have any mileage with the bank, assuming he paid for it by C/Card?

  • The ASBO was put in place by Warwickshire Trading Standards. It includes this clause "Acting in such a manner as to cause, or be likely to cause, alarm, harassment or distress to any person in the course of his trade, business or profession."

    The problem is the business is in Worcestershire and it requires a coordinated effort by trading standards to make a case the order has been breached.

    Well he hasn't breached the terms of his asbo by selling cars and you and I both know the police aren't doing anything.

    Use the money you intended to use for court proceedings and enforcement action to repair the car.

    You'll probably win at court but there isn't anyone to claim the money from.
  • Hi we are in the same situation. We brought a car in October. It developed a fault within a few weeks and was advised by CW cars to bring it in and leave it with them which we did. After weeks of being told what the issue was and that they were "resolving it", (essentially being fobbed off) we were given the number of Paul who owned the business. Paul promised us that the issue would be resolved and then we heard no more. After another couple of weeks of phoning and getting no response we popped into the garage to find all the cars gone and the unit all locked up.

    We asked another garage unit who told us it had gone out of business. He also had our car key which he handed over. We thought at least we had our car back. On getting into the car we noticed the fuel was empty despite going in with a full tank, which is when we realised the car had done an extra 2500 miles! Frustrated we drove the car about 200 metres before realising that the brakes didnt work.

    We have engaged with the credit card company, but they need proof the business has closed and they havent even done that properly so now we are stuck without a car, having paid for something that doesnt work and no way of claiming back against the Credit Card company as they havent even closed the business down properly.

    This has to be illegal??

    They may well have done it properly. Just because the business has gone and it's still active on Companies House site doesn't mean it's hasn't gone into liquidation.

    You should still be able to do Section 75 recharge whether or not the business has closed as the vehicle was clearly not fit for purpose.
