Help! Have followed advice so far...but worried

Hiya,
Have since received LBC from Gladstone’s and followed advice re SAR to UKPCM which they have kindly sent me, plus request to Gladstone’s re Restriction of Data Processing...
I now have an email from Gladstone’s giving me 30 days to either pay up or give a substantive response.. OR they MAY elect to issue legal proceedings without further notice... What do I do?
I have plenty of video evidence now showing the lack of visible lit signage at the entrance plus small lettering of the sign (it was dark) and the fact that I wouldn’t have seen any other signs if they were there at the time of the alleged offence.0 -
Nothing to do , you are in limbo land , frozen , awaiting developments2

post #1 - ".....apparently parked in a UKCPM car park"

Just checking - post #22 a typo?1 -
Which is the typo, 'UKPCM' or 'kindly'? They are not ''kind''!SAR to UKPCM which they have kindly sent me,PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hiya,
Thanks for letting me know that, was just checking!
Thanks again0 -
Hiya Coupon Mad,
Yes indeed probably both!! Am quite a polite person!0 -
Looks like am going to court...! Some advice please on how to proceed at this stage...
Claim issue date is 9 Dec 19 therefore I have till 28th Dec to get first bit in? (AOS)
So just want to make sure am going to be doing this right.
It says in the pack I received that if I wish to have 28 days to prepare my defence (I do!)....
To fill in the acknowledgement of Service.. to arrive by 28th Dec...So I send this off and then fill out defence and Counterclaim form N9B (SDT) to arrive by 11th Jan latest..
I can ask for extra time.. Any advice on wether I will need it please? (Not sure how much detail my defence is... ( I have video evidence showing the route and unlit signs) and can draw a map of the route I walked when I left the car (not passing any signs again..) if necessary...
So I think at this point I’d like to know just the basics and will post again about my defence once I’ve done this bit?
1) Am assuming the box on the AOS i tick is box 1. I intend to defend all of this claim?
As definately not box 2. “Part of the claim” and don’t know what box 3. I intend to contest jurisdiction means?!
Be grateful if someone can let me know I’m doing this right as been misreading a few things lately when under pressure!
2) Also do I need to send the AOS (signed for delivery) or registered post or something?
3) It says a Northampton address for the court.. will I have to go there???
4) As long as I send the defence form (N9B) by 11th Jan, i can do this separately..?
sorry if my questions sound dumb and am repeating myself... just have noticed a few of my own misunderstandings lately due to pressure!!
All help gratefully received0 -
With a Claim Issue Date of 9th December, you have until Monday 30th December to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. To file an AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.Claim issue date is 9 Dec 19...
Having filed an AoS, you have until 4pm on Monday 13th January 2020 to file your Defence.
That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence could be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
You won't be going to Northampton. Later in the process you get to choose your local County Court.2 - Sign it and date it.
-
follow the above instructions
the Northampton address is NOT a court, its a government office that does all the prelim work
you chose your local court later on at the DQ stage, so read the timeline post by bargepole , so google your local county court for civil claims
both the DEFENCE and the DQ will be EMAILED, not POSTED
I have no idea why you would be doing a counter claim ? what for ?
what would your counter claim be about ?
how much for ?
how much would it cost you to file it ? (check after deciding the sum claimed)
it is rare for anyone to submit any counter claim in these matters
just because a court claim is filed, it doesnt mean that court is inevitable , not all claims get to the actual court room
Email a SAR to the DPO at the PPC if not done so already, attaching proof of I D such as a copy of the claim form2 -
You really needed to have read some claim threads by now, as all your questions are basic stuff that any defence thread would show you the answer to. It is worrying that you hadn't read enough to be expecting this and know what to do, as the best prepared posters are the ones likely to confidently win their cases and claim their costs with their heads held high.
So put that right now and stick around, read LOADS of threads like your own.
Also read CEC16's thread. It is vital you understand what was said at Southampton.
See KeithP's reply, read the NEWBIES thread post #2 and get up to speed. Tell us that you have done the AOS in good time, then show us your draft defence, based on the 17 examples in the sticky thread and/or plagiarised from a similar (2019 only) thread you find by searching.PRIVATE 'PCN'?
