Employer accusing workers of abusing companies sick pay

    Maybe they did not think to look further into it until after they paid it.
  • Question - if employee is healthy and faking illness and employer knows about it and have evidence but still pays SSP (statutory sick pay). does the employer is not breaching the law? because government explains that only eligible employee qualify for SSP

    Like I said, they might not have investigated it until afterwards.

    yes it could be a reason, but they informed me from day 1 sickness that they believe i abused company sick pay and wont pay me. So they looked in to it before they paid and made this accusation before i got payed.

    Only they can give the reason. They must have a reason why they think you have abused the system.

    so they had this reason and said they wont pay me, and accused me, and when i came back to work, they paid me and sent me to disciplinary. So why they paid me if before they made this allegation, and told me they wont pay me.

    im just saying they created the reason after.
    they accused me before and paid me to have the reason. Otherwise how could i abuse sick pay if i dint receive it?

    I'll say it - on at least one of these occasions YOU WERE NOT SICK. At least, that is my understanding from what you have told us. I understand you had an injury.

    Maybe I am wrong. Does your job entail standing all day? If it does not, surely the response to a foot injury is to contact the employer and say 'I really cannot travel to work. Do you have anything I can do at home'? Not just to take time (was it a week?) and expect full pay, which I understand you were paid at the time. If the job DOES entail standing all day, it is still worth asking the employer this question. Obviously the question is then in two parts - anything I can do while at home, and anything I can do once I can get into work but can't stand all day.

    So should not pay me companies sick pay, because they informed me on day 1 I became sick that they stop CSP because they believe i abusing it, and will investigate it. Despite this later they paid me, in the midle of investigations where they also stated they wont.
    If they would not pay CSP there would be no CSP abuse, do i think correctly?
