Received a PCN from EuroCarParks

Hello All,


Looking for some advice as I have just received a Parking Charge Notice from Euro Car Parks, which is the car park for a local supermarket area (where we have several shops) in Hamilton UK. I did not receive a ticket on the car on the date in question and this is the first time I have received anything from them.

I just received a PCN from EuroCarParks telling me to pay £40 for parking longer in the car park than permitted. I received the letter through the post to my house on the 25/11/2018, the incident occurred on the 14/11/2018 and if I don't pay by the 05/12/2018 the payment rises to £70. I have read the NEWBIE's FAQ's and still am unaware of what to do and wish to have some more clarification, I've read several forums not only from here stating everything from PAY IT NOW to DONT PAY AT ALL, so I'm really confused on what to do, hence me asking here.

I'm still in time to pay the £40 before the 05/12/2018 but I don't really have the funds to do so, hence me asking if I REALLY have too. The letter states this...

"PARKING CHARGE NOTICE AMOUNT DUE: £70
Payment to be made within 28 days of the date issued: by 19/12/2018

This parking charge is discounted to £40
If paid within the first 14 days of the issued: by 05/12/2018
After this date, the full charge amount will be owed

Location: Hamilton Retail Palace Ground in Scotland
On the 14/11/2018 the vehicle: (Registeration number) entered Hamilton Retail Palace Ground in Scotland at 15:06:05 and deprated at 19:07:22 (3 hours max and I went in a little over 4).

On the 14/11/2018 you were the registered keeper of the vehicle (Registration number) or you have been named by the registered keeper as the driver/hirer at the time of a breach of terms and conditions of parking.

We are using cameras to capture images of vehicles entering and leaving the car park to calculate their length of stay. The signage, which is clearly displayed at the entrance to and throughout the car park states the this is a private land, the car park is managed by EuroCarParks and sets out the terms and conditions of the car park by which those who park in the car park agree to be bound. The parking notice (ID of notice) has been issued as the vehicle was in breach of the following terms and conditions:

Your vehicle was parked longer than the maximum period allowed.

The vehicle was parked at Hamilton Retail Palace Ground in Scotland by remaining in the car park without authorization, in accordance with the terms and conditions set out in the signage, the parking charge is not payable to Euro Car Park (as the creditor).

If after 28 days beginning with the day after that on which this notice is given, the parking charge notice has not been paid in full, you will incur additional charges resulting from your details being forwarded to a third party debt collection agency. "

So, what should I do? :(

    having the funds or not is irrelevant

    if this is Hamilton, is that Scotland ? (ie:- near Motherwell)

    assuming its Scotland , read that NEWBIES thread again and check the advice specific to Scotland where you have different laws

    I've read the newbies and everything about what they say about Scotland but I'm still unaware of what to do, do I just ignore, do I email or what? I know it says this...

    IN SCOTLAND/NI, CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM.

    IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.

    WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS."

    But still doesn't answer what I SHOULD do, what does it mean by complain to the retailers?

    The event took place in the Hamilton Retail Palace Ground in Scotland. Yes, near Motherwell.

    IGNORE the parking company

    and complain to the retailer or retailers (or landowner if applicable)


    seems pretty obvious to me, its not rocket science

    ie:- IGNORE one, complain to the other

    Right, so Ill ignore the company, but how do I know who the retailers or landowners is, and what do I say to them?

    Again, sorry if its super easy, just new to all of this.

    What it says, and there are examples given. You need to read more of the sticky.

    There is a link in the NEWBIES thread called 'SUCCESSFUL COMPLAINTS ABOUT PPCs' showing you how to get PCNs cancelled by retailer complaint, with hundreds of examples over the years.

    so assume its not a parking fine but a can of spoiled baked beans containing botulism and you were ill or you had slipped on a wet floor on the premises and injured yourself

    who would you complain to ?

    how would you find out ?

    the fact that its a parking charge isnt really relevant, it could be anything

    Well Homebase, Currys, Argos, Pizza Hut, KFC, etc all appear to be retailers at Hamilton Retail Palace Ground.

    Complain to all the retailers that you used pointing out that you spent a lot of money in their store but won't be visiting again because parking is too expensive.

    Take great care not to reveal the driver's identity when complaining.

    Visit each store... speak to the manager and say things like "we visited the store...".

    Well I did go to work in Starbuck for a couple hours doing some work while having a coffee, but Im not sure. Would I contact Starbucks? Im deeply sorry but I have no clue who to contact.

    Go in and wave the offending PCN at the Store Manager in front of a queue at the CS desk, and complain about the harassment...

    Google the retailer you shopped at, and the REALLY OBVIOUS WORDS 'contact us'... like you would for any trader to find the Head Office.

    Google the name of the Retail Park and look for who runs it (yes, you CAN find out, all retail parks have results that give you clue).
