Excell parking..bw legal threat of court proceedings

    I'm in a similar situation to you. I have been issues with a LBC by BW Legal for excel for multiple parking tickets from the same retail park...mine date back to 2013 though!

    I'm a bit further behind than you with my research but i shall be following with interest. I need to do my rebuttal and a SAR to Excel too.

    Did you manage to finalise your rebuttal letter?

    Ok guys so i sent the paperwork back to bw stating i contest i wasnt the driver and do not know who is and a rebuttal letter requesting all papaerwork issue to me etc inc original pcns ... also in the same envelope a SAR.

    Fast forward two weeks and i have recieved 2 letters dated the same date but arived 2 days apart from each other. The first one is saying they will act on my SAR... and the 2nd letter is a final notice stating i must pay in 14 days , no mention of my rebutal or anything or even an acknowledgement of it??

    Is this normal?

    Do i contact them via eamail or phone to chase this up? Or do i have to resend everything again? I dont understand why i have not recieved acknowledgement in any way apart from tbe SAR

    In my rebutal statement i also asked them what evidence they are relying on and also all copies of documents and notices issued to me from day one...when will i get a acknowledgement and response on these being sent and my questions being answered?

    you might not, but its all grist for the mill


    just ensure you have emailed a SAR to the EXCEL DPO to get all their data on you, if you have done this then EXCEL have 30 days to reply to the SAR, or you can report them to the ICO

    Thank you, i sent a SAR to both excel and bw
    Bw have responded to say they will action this but nothing from excel. All done by post. And also a final notice came from bw again no acknowledgement of anything other than the SAR so just waiting on answers to what they may rely on in court and also all relevant copies of notices and warning issued to me.

    if the SAR to EXCEL has been longer than 30 days, email their DPO and complain and reproduce the SAR you sent (chase it up)


    there was little point in posting it when they have an email for it on their privacy page

    Ok so i have had the SAR back from bw which contains copies of letters a copy of the SAR letter i sent them and copies of the reply form they sent me (no copies of the reply form i sent them the same day as the sar and no copy of my rebutal statement either?) Theres a copy of a letter that bw supposedly sent me in 2016 included and thats it as the rest of the pages just contain several subheadings such as vehicle details...for parking enforcement bw legal may be provided with your details including: make..model..colour..reg..images.

    The list goes on with just general data categories but nothing specific in terms of detail.
    They have it seems ignored my rebutal and response form or are pretending to have not recived this? Do i email them another copy? I am also still awaiting a sar response from excel so may email them to whilst i am at it...

    you now await the SAR reply from EXCEL, which is why I mentioned emailing it to be sure they get it, even if they get it by post as well

    Ok so to be clear i am not to be concerned there has been no mention of my rebutal or reply form sent to bw? And i do not follow up on this?
    As bw have since the inintial letter before action letter now issued a final notice acting as if i have issued no response to them which is not the case as i sent tbe form they requested along with my rebuttal... confussed as i thought i woukd get a reaponse as i have asked what theire client intends to rely on and also asked for copies of pcn issued to me of which i have not recieved...has anyone else had this situation? Should i have emailed it maybe or sent it signed for delivery???

    And i just simply email a copy of the sar request to excel as they have failed to respond to my written request?
