What is the Issue Date on your Claim Form?

You now need to be reading post #2 of the NEWBIES FAQ sticky thread.

Issue date is the 21st December, does that mean I have till the 10th of January to reply? Couldn’t of fallen at a worse time as we are away from tonight until the 2nd Jan, just hoping I can reply when I get back rather than worry about it over Christmas!

With a Claim Issue Date of 21st December, you have until Wednesday 9th January to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

Having done the AoS, you then have until 4pm on Wednesday 23rd January 2019 to file your Defence.

That's a whole month away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.

When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

do as KeithP says above ^^^^^^^^^^^^^^^^^

do the AOS now, or tomorrow, BEFORE you go away

ALSO, post your complete POC below, and the charges breakdown from the form, the original NTK or PCN charge (as indicated on the signage), but NO personal info

then enjoy yourself and when you get back start drafting your DEFENCE

Hi, thanks for the swift responses, I’ve read the thread post and got the Dropbox guide so will file the acknowledgment first thing in the morning as about to head out for dinner!

I’ll then upload pictures of everything we’ve received so far in the morning and head off to deal with it when I’m back!

    Thank you all!

no idea where you think you will be uploading the pictures because it wont be here

if you are going to do this, REDACT all the PERSONAL information and references from the claim form etc FIRST , NO ROOKIE ERRORS

THEN HOST ON TINYPIC OR SIMILAR AND ADD A DEAD LINK IN YOUR REPLY (so change http to hxxp)

doing the AOS on xmas eve is fine, just dont put anything in the defence box, that can wait a few weeks and in any case will be emailed as a signed and dated PDF attachment, it wont be done in the online box anyway

Ok filing the AoS shortly and will send a dead link as done previously with all correspondence we’ve had!

As mentioned above we are going away this afternoon for a week so I’ll check back in when I can but won’t be fully back till 2nd January!

    Merry Christmas everyone!

One quick question as about to do the AOS, any point in filing a counterclaim? I wanted to try and screw these companies over as much as possible due to the stress related issues we’ve had with the harassment, but not sure if it’s actually worth trying this or if it will just prolong everything further!

Trouble is that it's a small claims court within limited costs being awarded.

Best to get a really good defence and find all the flaws in what BWLegal say ...... that will not be difficult ?

When you win have your costs schedule ready.

Bear in mind that BWLegal send "rent a mouth" newbie legals to court who don't seem to have a clue
  • Thanks beamerguy, as I wrote it I thought I couldn’t be arsed to deal with the extra agg!

Ok AOS all done and all correspondence photos taken, will just redact all info and send a dead link shortly!
