    Hi everyone, been a long time but thought I’d send a quick update.

    Received a court date for August back in February, now we are just over a month away and I know that there a few bits I need to do prior to this I.E. witness statements etc, is there a deadline for this or should I wait to hear from the courts as we’ve had no correspondence since the initial court hearing date letter.

    Look again at that letter that gave you the hearing date.

    Does it perhaps say something like:
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].

    Hey everyone,

    So I’ve looked through the court letter and it states we should send any documentation to all parties 14 days prior to the court date.

    At this stage however I’m not sure what if anything we should be sending across, apart from our defence, which was filed back in February is there anything else I should send over.

    I’ve read through some of the posts on the newbie thread regarding the witness statement and I think my defence covered off a lot of what I would put into the witness statement, I’m a bit lost if I’m honest!

    Also, further to the above, will I find out if the claimant has paid the trial fee? The due date was yesterday but nothing has been updated on Mcol yet so I’m hopeful they forgot!

    You send your witness statement and evidence pack to meet the deadline imposed by the court. You send (or ideally take) it all to the local court and send to the claimant by e-mail. Check out NEWBIE sticky post # 2 for examples of witness statements, which are your chance to say what happened on the day and to include any evidence that you have referred to in your defence.

    You can keep checking MCOL to see updates or you could try phoning.

    Nothing will be updated on MCOL once the case has been transferred to your local court.

    No point in looking at MCOL any more.

    Thanks KeithP for the correction. OP, phoning the allocated court is then the preferred option.
