Thank you Coupon-Mad, Deleted now!
And filed my defence via email as per Kieth's message.
Will keep an eye on MCOL over the next few days to make sure it's marked.0 -
Morning everyone!
So we’ve just heard back from both the courts and BW in the last two days, one letter with the courts directions questionnaire (that we will fill out as per newbie thread and send back).
2 letters from BW the first with their directions questionnaire a few days ago and this morning a letter with their full defence (copy and paste job by the looks of it) and then a statement telling me I should either go mediation service to avoid “costly” court process or I could pay the now reduced amount of £160 as a goodwill gesture lol!
Am I right in thinking after I file the directions questionnaire it’ll just be a waiting game until such a time we get a court date? Or BW drop it

HA, no mediation for you, continue as if going to court.
Costly court process will be more expensive for BWL when they lose and you claim your costs..
A reduced amount is a last ditch attempt by BWL WHICH SAYS, they don't want to go to court0 -
BG is right ^^
While we can't give guarantees, this looks like a start towards discontinuation. Their recent hoovering up of old NCP and Britannia tickets and issuing court proceedings is not sustainable - they cannot possibly take such large numbers to court. Any resistance from individuals will likely see them as much less attractive to continue pursuing.
But 'court' isn't their main objective, it's debt collection, pure and simple, and no doubt their strategy of applying widespread fear via their MCOL claims will pay off handsomely ..... as terrified recipients swiftly reach for their cheque books. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi, Very quick question, can I file the Directions Questionnaire via email in the same way I did my defence or does this need to be sent in the post? Also with regards to sending it to the claimant, would this be BW or NCP?
Thank you in advance!0 -
The claim form will have the address for service upon it. That is there precisely to clarify this point. It is usually near the signature of whoever signed it (mcol claim forms have a slightly different layout).
It's almost certain to be the solicitor (but do check)0 -
Ok so it's BW Legal on the claim form so I'll email them a copy. Can I also email to the courts or should I send via post?0

You can email the CCBC.0
-
Thanks, emailed across to them and sent off the to only email I could find for BW, some enquiries one.
Speak to you all soon once I hear back!0
