I've just updated the list in post #5 above to include:
Good idea. But will anyone read it? Not sure we'll have long to wait! :D

Well done on making things more and more helpful, and easier for those able to make good use of the excellent advice on the forum.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Thanks all for your advice. I’ll try the Court again tomorrow. I assumed I would have heard from the by now but of course won’t take anything for granted!
  • I’m at a similar stage with CEL. Called the court yesterday and they confirmed that no DQ had been sent and were waiting on CEL, but they also said they were very behind on their post and yesterday were looking at correspondence received on the the 28th November. I would expect the court won’t get passed the 29th November with the Holidays
Basically the Court said we were looking at early January 2019 before we can really say it is properly stayed.
They also confirmed it would cost them £100 to remove the stay.
  • Called the court again yesterday they have confirmed CEL want to proceed and directions questionnaire was sent out on the 19th (haven’t received it so turns out the 45 mins on hold to the court was worth it!! I have been told I need to return it by 7th January so while I should be enjoying my time with my family thanks for CEL I’ll be working on this instead!!!!

Put it out of your mind until the 2nd giving you 5 days or best a day sooner.

Bear in mind that the courts know all about CEL PLUS more often than not they discontinue at the last minute

Follow this through and be mindful that CEL practice dirty tricks by misleading you that they will not go to court and do.
  • Thanks I will do. I really hope something will be done soon by the government to put a stop to these companies and their shenanigans it’s absolutely ridiculous!

When you have completed your DQ, sent it in the same manner and to the same email address that you sent your Defence, refer again to post #5 above for details.

Remember to send a copy to the Claimant - address on the Claim Form.

Hi again all, form completed, just a quick question if I may... (apologies if it has been answered elsewhere I have looked at other threads I promise!) On the top right of the form there is a box that says: 'In the' What should I write here? Or should It be left blank?

    I would leave it blank.

Hi all, me again, I have now received the General Form of Judgement or Order and need to prepare my witness statement. Facts of the case, vehicle allegedly overstayed in a car park behind a local sainsburies in Sept 2016. Defendant is the owner and driver of the vehicle in question, Defendant was accompanying an elderly gentleman suffering with alzheimers and vascular dementia with shopping. main points of defence being that the car park is inadequately and poorly signed, claimant has failed to prove authorisation to bring the charges upon the defendant. claimant has applied unfounded charges to the original PCN, Claimant has failed to apply reasonable adjustments to cater for someone suffering with debilitating health conditions. I have revisited the Newbies thread which details the information required. I was wondering if anyone has any pearls of wisedom to share? And also if there are any recent threads where I can obtain the correct wording for the points required (IE differentiation from the Beavis case etc) Thanks in advance
