Day 186: responded (by email, using assumed name) to BPA with PCN number and date and time of alleged breach.
Day 190: response from BPA: They have received response from Indigo, which has, btw changed its name to Saba. Their response was that during the hiatus the decision was taken to use ITAL and that took time to implement. As such it was not until 1st November 2018 (convenient date that!) they were in a position to provide the service, and it is not back-datable (says who?). Apparently, however, I "will be able under Railway Byelaw 14 to take [my] case to a magistrates court should wish to do so"!
Thanks again for all your invaluable advice and support. I hope that my journey is also helpful to others.
letter/email dated after say 185 days stating you can refer it to magistrates is simply wrong (on my grounds)
tut tut , BPA do they not know laws of the land0 -
Send an SAR in a month or two to see what data they hold about the keeper. If they still have it, complain to the ICO, BPA, DVLA, and your MP.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0

ASk the BPA how they think you can prosecute yourself for an alledged offence that has timed out?
A template reply not written by the office teaboy would be appreciated0 -
as can be seen from the above , the BPA know very little about railway bylaws - just %^&^!!!!! fed to them by indigo , so how the hell can they comment and recommend ital
I think they are now rather happy to lose this problem , and will let people argue with indigo/ital and the DFT , whilst standing carefully in the wings0 -

Tell them not to be so stupid, YOU can't take it to Mags court! As nosferatu says:Ask the BPA how they think you can prosecute yourself for an alleged offence that has timed out?
And tell them they MUST tell SABA to erase your data now or you will complain to the ICO as the 6 months are up.
Good suggestion by Fruitcake:Send an SAR in a month or two to see what data they hold about the keeper. If they still have it, complain to the ICO, BPA, DVLA, and your MP.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks
I have responded. I'll update with any response.0 -
Definitely. Many thanks for your continued updates. Looking forward to the final stretch of their responses now after time up0
-
Useless response from BPA - they note the contents of my email! State that it is outside their remit to compel a member to cancel a parking charge notice or PN, and also do not have the authority to compel a member to remove data! That's the extent of the response!0

Indigo/Saba have been cocking a snook at the CoP for years.
It’s given the BPA a perfect opportunity to demonstrate they are more use than a car park in the Gobi desert. Sadly, it seems they are doggedly determined to prove that the MP who described them thus was absolutely right.0 -

Quality. Like. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
