    I have had two letters from my MP, and the issue has been (deliberately?) misunderstood in both - the latest one stating "As a Member of Parliament, it is not within my remit to instruct a private company in any way.", despite my reference directly to the ADR act 2015. An offer to write to Mr Philip Herring (Indigo MD) on my behalf has been made though, so I will write a third time to ask that he do so, but not until the 6 months are up so as to avoid giving anything away!

    The MP for the constituency in which the alleged breech of Railway Byelaw 14 took place, simply stated that he can only take correspondence from his own constituents.

    I'll update with any responses...

    Did you refer your MP to Sir Greg Knight's private members parking bill, and point out that MPs across all parties have stated this is an unregulated scam?
    Have you asked him if he supports the bill or supports the scammers?

    These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

    although I understand what your MP has said, it seems strange given that there are dozens of other MP,s who have done this, from all parties and all parts of the UK

    if they need guidance , refer that MP of yours to this page https://services.parliament.uk/bills/2017-19/parkingcodeofpractice.html and to speak or contact those MP,s that spoke about it in parliament and in the committee stages (they can check HANSARD too)

    tell them there is more to being an MP than just BREXIT and that sc@ms like these need to be stamped out and the DCLG and DoT need to get it sorted out, especially when the Lords have passed that bill

    perhaps they were asleep when all 3 readings were made in the House Of Commons ?

  • Day 172: Received response from BPA to an email complaining about Indigo's refusal to off POPLA citing the suspension in September 2017. They ignored my point about the ADR act, but confirmed that despite independent appeals being reinstated, "this is not being backdated", and that therefore Indigo is not in breach of their Code.

    A response has been sent requesting clarification on how those caught during the hiatus are expected to get an independent appeal - suggesting perhaps that the BPA is instructing its members to cancel any contested penalty charge notices issued during the suspension...
  • Day 178: Received response from BPA asking for further information - notice number, date etc. and confirming a complaint has been logged.
    As the 6 months is nearly up, I will wait to respond, but I will respond as there are still many others caught in the hiatus between mid July and 1st November, who, like me will not be being offered a POPLA and who will be being pursued by ZZPS.

    You'll likely be disappointed if you think there'll be any hard or fast resolution. These things almost always drift into obscurity. The only resolution the PPC will want is a cheque in the post. Indigo won't allow it to come to a resolution that negatively impacts their overall Railway Penalties business model.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Day 185: emailed Indigo to tell them time's up - remove all details and instruct ZZPS etc. to do same.

    Day 186: responded (by email, using assumed name :) ) to BPA with PCN number and date and time of alleged breach.

    Day 190: response from BPA: They have received response from Indigo, which has, btw changed its name to Saba. Their response was that during the hiatus the decision was taken to use ITAL and that took time to implement. As such it was not until 1st November 2018 (convenient date that!) they were in a position to provide the service, and it is not back-datable (says who?). Apparently, however, I "will be able under Railway Byelaw 14 to take [my] case to a magistrates court should wish to do so"!

    Thanks again for all your invaluable advice and support. I hope that my journey is also helpful to others.

    Ask them how do you take yourself to the magistrates court? That is utter stupidity.
