How old is your daughter is she legally able to make credit card payments I seem to remember somewhere about refunds being made when the purchase of was underage and could not legally be held liable for the purchases0

She isn't the OP's daughter.
If the cardholder wishes to avoid the transactions by avoiding legal liability on the basis that the daughter was underage then the cardholder would also be dropping the daughter in it for making fraudulent transactions - and the age of criminal responsibility is 10 in England and Wales.0 -

The counter claim to that is the parent had the card details stored on the account from a past purchase, as far as im concerned the bank shouldn't be accountable nor should Microsoft be.0 -

They can make a claim - a real claim, not a fraudulent claim - but the likelihood that such a claim will result in a refund is next to nil.
Think about it - if all you need to do for a refund is say your child made the purchases without your knowledge o. authorisation, everybody would have a rogue child and claim their money back after having played their games,0 -

The excuse would only work a set number of times before the banks would work out what was happening and dont pay out.0 -

As has been pointed out earlier in this thread, the transactions were not made without her authorisation. Authorisation was given when she set the card up on the account. The fact that the OP did not check the terms and conditions and did not put into place the safeguard that were available is does not make the transaction fraudulent.0
