You write a defence and email it to the court

If youre not understnaindg its because youre reading everything all at once

    These points absolutely WILL apply
    - poor signage
    - no standing to offer contracts or puruse to court in their own name
    - POFA complaince to hold the keeper liable (not useful if the driver was identified)
    - amount is not prominent and not a core term.

    THats just a starter.

Thank you, this gives me something to work from, much appreciated. Few bits could you explain a bit more as im unsure exactly what it means?

    - no standing to offer contracts or puruse to court in their own name.....unsure?
    - amount is not prominent and not a core term - also unsure?

Cheers, sorry to drain your day

Put it in. It is their job to prove their case. If you bring something up then they have to prove it isn't correct. Don't just assume signage etc is ok. Assert that it isn't and make them prove it is.

Facebook page: Fight against Unfair Parking Charge Notice

Private parking firms issue THOUSANDS of unfair £100 tickets because they think you won’t bother to fight them. The letters they send out are written in such a complicated, intimidating way, that most people end up paying just out of confusion. Private parking firms enjoys the lack of information among motorist for their rights and take advantage of the fact that most of the appellants give up when it comes to defend themselves in the court because of the process and financial implications involved.

The purpose of this group is to provide a platform to:

    1. Share their own experiences with others
    2. Make them aware the step by step process to challenge the parking charge notices
    3. Provide financial help to appellants to fight for the justice in the court. If everyone starts challenging the unfair parking charges in the court, the private firm will be forced to not to go to the court to enforce the tickets and the appellant will eventually not require to pay the charges.
    4. Expose the private parking firms for sending out the unfair parking charge notices

Stop spamming this board and hijacking threads that have nothing to do with you.

I've just looked at the FB page, the originator of which seems to be the spammer here.

It is so lightweight and clearly lacking in any substantive understanding and knowledge of the skimdustry, it is likely to do more harm than good to the unwary, unsuspecting and those thinking they've found private parking charge avoidance Nirvana.

Well intentioned, but potentially dangerous stuff.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Perhaps he can, thanks for the heads up Keith:T
  • UPDATE:
Been to the pub where the ticket originated from and the manager was very apologetic and said that the system they run has caused nothing but problems etc and he took copies of my claim forms, took my details down and said he would ring up today and do what he could to have it cancelled. SO fingers crossed but I will still prepare for it to be going ahead to court still as before, just hoping it will get dropped.
