Risk of court/CCJ but UNFAIR

Okay so I will give the back story so you know whats going on but I am very stressed and worried at the moment and running out of time to reply.
So december last year, I went to a pub fairly local to me and they have a private car park to park in and to stop you getting a ticket, when you go in to order a drink/food, you give your reg number and they write it down and that stops you getting a ticket. I did this.
2-3 weeks later i received a ticket through the post from some private parking ticket company, saying id been caught on ANPR in this private car park and i was to pay £50 or £100 after 14 days etc. I went back to the pub, explained and they said DONT pay it, they would get in contact with the parking company and get the issue sorted.
Months gone by and just now ive received a letter from Northampton County Court Business Centre, claiming for £255.73 as ive not paid the ticket and i could end up with a CCJ against me etc. :wall:

So ive been back to the pub, they say its out of their hands, its Civil Enforcement LTD claiming against me, they say its nothing to do with them, the County Court Business Centre say its not down to them, I'm just being passed around and I dont know what I'm meant to do or if I dispute it, what evidence I can gather to back me up? I havent got £255 even if I wanted to pay it, it shouldnt have been issued in the first place and no one is helping or listening.

Really not sure what I can do, what I can say, or where to go with it.

  • Of course its unfair, its a SCAM pure and simple.


    However you have got a claim form and you will have to defend it unless CEL discontinue which good news, they do discontinue if you deal with it exactly as the regular posters on here tell you to.


    As an aside, do you know who you spoke to in pub?, have you got a name? can you contact the Landowner OR brewery management to get this cancelled? don't be fobbed off by some ill advised person saying 'Out of my hands' IT ISNT!!!! and as another form of attack make the person who gave you that advice aware that if this goes to court you will require a WS from them as evidence, this might shake them up into acting, its ridiculous that they're attempting to wash their hands of it and you make it known you wont be fobbed off (Politely but firmly)


    Plenty of CEL defences here so no need to stress, they CAN be beaten, have a thorough read of the newbies section and in particular CEL defence threads

    Have you responded to the claim yet? That's your first priority. By faffing around you may have missed the boat and now have a default judgement against you.

    There should have been instructions as to what to do with the paperwork you were sent.

    Anyway if you haven't missed the boat then at the top of this board is a thread that tells Newbies to read it first. You need to study the second post in that thread carefully. You will see a Dropbox link in it. That link contains a pictorial guide as to what you need to do.

    Your next post needs to either confirm you have opted to defend or tell us if you have a default judgement.

    Thanks for your reply. I dont know the name of the person but he was just a regular bar person? I cant believe the system they have in place. Its one persons word against another.
    Is it not something along the lines of, Civil Enforcement have "bought" the debt off the original parking company, ie PCN or whatever it was? So it technically isnt to do with the pub anymore as its been bought on effectively?
    I am worried if I try and defend this matter, then I will lose and end with a bigger fine and a CCJ and im not sure what evidence I can physically send back to them as part of my defence.

    Are you advising I respond defending myself and they'll more than likely drop the matter?

    I have not responded yet at all but I am stil within the original time frame. Wondering how I am to respond and what with.

    Write bad stuff on the Pub's Facebook page and on TripAdvor if there is one. Complain to the brewer and your MP.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
    for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    You really need to start reading the newbies section in detail and learn more about the game you are now involved in and read CEL threads.


    Its not a fine, its a speculative invoice from a parking scammer who preys on people folding and paying when they read scary letters that lie about the power/s they usually don't have.


    Civil Enforcement haven't bought the debt, they are the parking scammer and somebody at the pub or representing the pub has employed them contractually to operate their parking scam on the land, do explore who owns the land, do harass the pub to do something because THEY CAN!!!! and lastly don't panic this can be dealt with, just takes time and effort.

    How do I get in touch with my MP? I really am a newbie and havent a clue what to do, feel very bullied and cornered into just paying it right now.
