You mention both 'Albert Car Park' and 'Albert Road car Park' in that letter.
It appears both need changing.
But you did say it's a 'rough letter'.0 -
Thanks KeithP, (just wanted to know if I am going in the right difrection). I will change that, does the rest seem ok?
Also, I will send this via email. The person who wrote to my O/H is a so called litigation officer Mr James Burgess ( I’m sure I have seen few similar templates of this letter from this person online but the job title is different). Do I address this to his email?
I will make corrections and post here again.0 -
Would this letter still work if the Letter before Claim if from VCS litigation department?0

Is from VCS litigation department*0

He even cancelled the next job he recieved to try and see if he can fix the problem. It took him I think 29minutes while he was there.
Could he get some sort of statement / evidence of this for a defence. Seems to be a strong point.
There is also a technical defence for that car park in that the signs are Excel and not VCS but evidence from the taxi company is better. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

He did ask his taxi firm, they said they can’t write any letters regarding that.
They can only give out a letter of partnership if requested.
Plus they don’t have records of cancelled jobs. Only of jobs that passengers cancel. As it’s all on an app.
That’s why I am worried regarding this defence.
He does have his work log record for the rest of the day. Which shows he was working after aswell.
Any advice how to get around this?0 -
You write a witness statement and have the witness attend, obviously.
THat is evidence
In the face of ZERO witnesses on the part of the claimant, that should be persuaive
THere is of course always risk. You cannot drop this to zero in court.0 -

Search for other Albert Street threads and add in bits from there about the signage. Though there is not a clean defence here, there is the makings of one using the different angles. He can challenge VCS's standing and the additional defence of "frustration of contract"This is a system account and does not represent a real person. So he just writes his witness statement after the defence stage? Can you explain please, I am getting confused.
At the moment do I just send the letter above with alterations or do I need to send anything else with it?0 -

Are there any examples of challenging VCS standing. And how do I go about mentioning ‘frustration of contract’ in the letter?0
