Vcs letter before claim...mistake of calling VCS when receiving NTK...Help!

    I went down today to see signage at Albert street. It’s all been fenced off and had been demolished. There is no car park anymore. According to the notice on the fencing from LM working on behalf of Hs2. They closed it off since July 2018.
    Is there anything this can do to help further with the defence or no?
    Sorry I am asking questions like this. I want to know options of what this can mean for defence.

    I will later write a letter to VCS after I have recieved a letter of confirmation from the taxi firm.

    And wait for any claim. There are plenty of images of Albert Street and pics of their so-called contract there too.

    No point in doing much more than you are doing until you see if there is a live claim to deal with.

    My husband asked his taxi firm, they can’t write a letter to confirm but told him to print off the fare information which he did as it has the car reg on it. They do have a letter of partnership ( would that help?) the firm don’t have records of cancelled jobs but only keep records of passengers that cancelled the fare.
    Also my husband didn’t have any work done on the car,so no receipts. I’m worried now how to prove his car had problems.
    His car had some electric fault that one of the engine warning light lit up. So he waited and tried to check. But it went after a while.
    What can we do regarding the letter. Only proof He has is of the job route that terminated at Albert street with the instruction of the passenger.

    Please help I’m getting stressed.

    He obviously just writes saying the taxi broke down as it had an intermittent fault, and says his letter must be considered a SAR (subject access request) and asks for all photos and a copy of the signage that was there, like this one:

    See the ending needed, calling it a SAR and Objection to Processing data, and he should say that he will complain to the ICO if VCS do not supply all data held including a dated/contemporaneous image of the sign they allege was contravened.

    (the point of all this is merely to get some info, to help at court defence stage where these cases can be won - there is NO RISK of anything bad, by defending a claim).

    Major complaints should also be made to your/OH's MP and the MP of the area where the alleged event occurred if different.

    This is an unregulated scam. Our MPs have said so in open parliament, and targeting a taxi is an absolute disgrace and will drive custom away as has already happened in some places where taxi drivers are now refusing to take passengers.

    i have written a rough letter to send. please feel free to give advice, and alterations needed. This is the first time i wrote something like this. so im not sure if it makes sense.

    Dear Sir
    Ref: PCN ref xxxxxxxxxx
    I am writing in reference to the recent letter before claim sent (Date) demanding for payment of the parking charge. I have explained previously through phone calls and an email sent explaining the incident (date) at Albert Road car Park.
    I am a private hire taxi driver, car registration (xxx xxx). On the day of the incident I was working and driving on the request of my passenger, whom wanted to be dropped off at the Albert Car Park, as it was easier for them to walk towards New Street Station. I have attached a journey route of the journey I had made to prove I was on duty at the said time.
    However, upon leaving the car park my car broke down as it had an intermittent fault, which resolved after a short while and I left the car park.
    This letter is not an appeal, it must be considered as a Subject Access Request. I would like to request for all data held and processed which is;
    - All the photos taken on the day;
    - All human intervention notes;
    - All electronic data including automated decisions to generate letters;
    - A close up of the sign on the day with the car parked/empty in the same view;
    - All photos relating to this case, without holding none at all,
    - Copies of the PCN and all letters sent.
    This is a Subject Access Request but also an Objection to Processing and a formal request to Restrict Data Processing. As such, any litigation MUST be on hold and I will be making an Information Commissioners Office complaint for the mishandling of the Subject Access Request and Restricted Data request and misuse of my personal data evolving from; intrusive, unjustified, predatory and disproportionate collecting of photographic data of a car with a driver in it not parking at all and certainly nothing can be described as ‘reasonable cause’ to get DVLA data and demand money.

    I also noticed I wrote Albert car park when it should have been Albert Street car park.

    Should I demand for a reply within a certain time limit? eg. With in 14days. I forgot to add that in to finish off.
