FURIOUS! parking fine recieved when no ticket was issued

    CAB would have been a waste of time, as would TS. They don't understand the difference between private parking invoices and fixed penalty notices. They undoubtedly would have told you to pay it!!!

    They have to employ companies to manage their car parks due to people abusing them.

    Really if you overstay and get fined I can't see what your grievance is, it's your own fault.

    They aren't fines. No-one has the authority to issue a fine except for a court of law. These are invoices, and you can safely ignore them.

    The above thread unfortunately does not clear up any doubt on the legality of the fines. It would be misleading for people to think that they can rely on the judgment.

    Wasn't this done to death recently?

    Unless it's a Statutory Authority issuing the penalty notice, then it cannot be legally enforced because no law has been broken.

    It's very simple.

    The private parking company may well request the Registered Keeper's details from DVLA but that won't reveal who was driving and the Registered Keeper is under no legal obligation to reveal that information.

    So the private parking company hit a brick wall. They can't pursue it via the Courts because they don't have a name to issue a summons against.

    Their "penalty notice" irrespective of how it's worded is actually nothing more than an invoice.
