Is it too late to respond to the letter before claim asking for information?

Clearly after asking the same question a number of times, you are tense. This is normal and there is a lot of information (but not all) in the Newbies thread.

If you want to do something today, then send a Subject Access Request (SAR) to the parking company (there is a template somewhere) to get pics of the car and pics of the paperwork.

When/if the claim arrvies, you send a second request for the non-personal information to BW and you ask for

    * pics of the signs
    * pics of the sign location
    * copy of their client's contract with the site occupier (if any)

This second letter can be a bit more problematic than the SAR but you have plenty of time to work on it.

Ask any more questions if you are unclear. Expect to be told (mistakenly) the answers are all in the Newbie's thread. But you will help yourself a lot by searching the other threads.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

As said ...... wait for the court claim. .... don't bin it ?

As far as the BWLegal email, it is a last ditch attempt
from them. If I received that, I would wonder why they have
issued one of their robo claims and in the same breath give
    you the opportunity to settle.

Could it be they actually don't want to go to court given
their poor track record in the parking industry ???

They continue to intimidate by giving the false impression
that they are the ones who dictate a CCJ.
Totally misleading information because there is only
person who can decide who wins .... A JUDGE.
If you lost then you have 28 days to pay and NO CCJ

YES .... wait for the claim form and come back here

BWLegal may still pester you but look forward to
seeing them in court especially as the courts know all
    about BWLegal ?

If you win ...... you claim costs against them

Thank you so much all of you. Yes I am a bit tense. I really don't want a CCJ. I will get on with what I can then post back when the claim arrives. And I won't bin it!!

If you follow what has been said, you will not get a CCJ

You dont just "get" a CCJ - it requires you to fail to file a defence, or lose at a hearing, and THEN choose not to pay wihtin one month of the judgement.

So your ex partner got you in this mess, why didn't you name them as driver if you are so uptight about it?
  • Its a little late however, if they have issued a claim
However you can laways point out no POFA compliance (no chance they were compliant in 2014) and youre not the driver (give full name of them) and they therefore have no possibility of success.

I have just received a Judgement for Claimant (in default) from Northamton County Court saying I have to pay.

Is there anything I can do now. This is the first correspondence I have received from the court.
