Hello there

I have received this email from BW Legal. What do I do next?

The parking charge relates to a ticket my ex-partner got in 2014. I have had no contact with either Premier Parking or BW Legal at all.

    No probably not! (Now edited)
  • So you need t oget reading

NEWBIES THREAD, post TWO on court claims. READ ALL OF IT. Dont Skim. Dont sya its too much

This prepares you for this process.

Firstly you will requier them to explain why they never served a Letter before c,aim, as required under the PAP for debt claims. Have you moved? If so, since 2014, then you need to confirm WHICH address they have used for service = if it is the wrong one you will need to inform then NOW that thiey have FAILED TO ENSURE GOOD SERVICE and the claim form will need to be reissued, at THEIR cost.

I have recieved letters from BW at my current address but I have just sent straight to the bin which I see now was stupid. I may well have received a Letter Before Claim. I have read the Newbies thread but I don't know which part applies here.

As you have already been advised,:

Post 2 in the newbies FAQ thread is the part that applies!

    Don't miss any court deadlines.

If you do then expect a default ccj against you!

As said before post 2 applies. You need to prepare to defend this. In post 2 there is a pictorial walk through of how you complete the forms. Study it as you really don't want to mess this up.

You also need to get studying defences. You have plenty of time yet so don't panic and don't overload yourself with information.
  • Of course you wait for the paperwork. Until that part there is nothing you can do

Binning them was insanely stupid. NEVER throw away a letter that pruports you owe money. The courts RUN on paperwork.

So I can't do anything now but Have to wait for the information from the County Court? Sorry if I am being dense here.

I have absolutely no information about the ticket apart from a rough date and the place it was issued. I have never even been there so I don't know anything about the signage that was there at the time.
