    What exactly was your counterclaim for?

    If it was for them 'not playing by the rules', how exactly did you quantify that?
    Is that a breach of the Playing By The Rules Act?
    And how can that possibly be a valid claim?

    You didn't read the NEWBIES thread and realise that your costs are something you list at WS stage?  Costs are not a counterclaim; if that were the case then the NEWBIES thread would tell you that.

    Loss of earnings and expenses. This should never have reached court stage and could have all been resolved if pre action protocol had been followed. 
    Why should I be out of pocket for other people's inadequacies.

    Then if you lose the case the counter claim will fail

    Those costs and expenses are claimed with the WS as a summary costs assessment

    Of course you shouldn't. That's what costs are for. That is not a counterclaim.
    You have now wasted the counterclaim fee.

    You shouldn't.  That is what 'costs' are for...at WS stage...free to list before your hearing and argue for them in court at no cost.

    If memory serves correct, I filed my defence last minute as I've had an awful lot going on as of late, I shalln't go into it here. 
    Re reading the newbies thread hadn't even occurred to me. 
    I'll take another look at it in the morning.

    Did you actually make the counterclaim alongside your defence and pay the court fee for it?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
