Yes, the case was heard in court, well sort of anyway.
The whole thing was a fiasco regarding their witness statement and contradictions within it.
I didn't really have to do much other than point out the discrepancies the judge hadn't seen.....shortly after he dismissed the case, and the counter claim but that was always going to happen.
I asked for my costs for loss of earnings,  I already have the cheque.

VCS / EXCEL seem to be in a constant car crash with their daft claims.

Either covid will kill off this wild bunch or the new code of practice will.

We all look forward to that

  • Hopefully something will end all of this.
I'm glad it's over for me now, it would have been far easier and less time consuming to have paid up but that's what they rely on I guess......picked on the wrong person this time.

    Hoping so.

Well, ending the worst abuses and reducing the race to court 'debt recovery parasites' mentality.  It's actually not the parking firms, in most cases, that drive these pathetic cases to court.

    Well done Turnip. :)

VCS seem to want to throw money at cases that they will struggle to win. There were issues here with the landowner contract.  If you take a case to court with an expired mandate what can you expect?

They would have probably pulled this claim at the brink if it had not been for the counterclaim.

You have beaten the bullies and that must give you some satisfaction. :)

    Very much so.
I was somewhat nervous about attending court yet the experience wasn't bad at all. It certainly wouldn't put me off doing it again.....hopefully I won't have to.
They still didn't provide a contract other than a 'witness contract statement'.
They also claimed to have not received my evidence,  the legal rep thought I was turning up to defend my case without submitting any defence etc, probably thought it would be a walk in the park.

They also claimed to have not received my evidence,
They do this all the time. Either they have the worst administrative systems known to mankind, or they are simply being untruthful!  Too many to be coincidental.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
