Re: account number / agreement number
I am writing to express my serious concerns regarding the telephone calls that I have received from your company.
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.
Yours faithfully,
And next time, ask them to hold for a minute, then click something and say, OK the "recorder is on now, carry on". They will ring off.If you've have not made a mistake, you've made nothing0 -
BAILIFFCHASER, I already tried cca request in the start thinking it would apply, but they just sent the postal order back.

Send them the cca again and tell them that the £1 sent to them is for the cca and not to pay the balance off. BC: They didn't turn up because you yourself said that this case was for a mobile phone bill and so not covered by the CCA1974.
You again said that the proceedings were adjourned for an "abuse of process" hearing.
EDIT: This was a bank overdraft that is covered by the OFT "part 74" exemption on credit agreements. Same principle though.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I can really see why you included this in your signature::rolleyes:
Tis was for a bank account. Also they claimed that they were not liable as in they did not have to comply with the cca. However they took the £1 and never notified my client of this and they never returned the £1 either. However they got the shock of their lives when this was issued. I undersatnd what you and the op are saying. To get stariaght to the bottom of this and or get the right persons attention(not at the dc) You need to do this sort of thing. Send them the £1 cca off. if they cash they are bound if they return then try plan3.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE. Not sure if I'm doing right or wrong by adding this, but I created this thread a couple of days ago.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
Hello Rog2,
It turns out the outstanding amount was actually a months rent and some phone calls, so I arranged for orange to send a copy of that bill. Only closer inspection of the last letter we received from orange stated there was still rent to pay, but unfortunately we did not receive it.
In the end I sent a cheque for the outstanding amount to orange on friday.
Thanks again for all your help, and i apologise for wasting your time aswell as others here that have also been advising me.
Regards

Eyeman - you have definitely not wasted anybody's time. Your thread has highlighted the fact that mobile phone contracts are not covered by the terms of the Consumer Credit Act, 1974, and, hopefully, has also shown that there are other ways to tackle problems like those your sister has encountered.
I am pleased that you have resolved the situation by talking to Orange, rather than having to try and 'deal' with the arrogant thugs at Moorcroft.
Good luck.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hello Rog2, thanks for that.
One thing i did want to mention is that we still haven't received a letter from orange stating that the debt has been cleared. I just dont want them to one day come back and say the amount hasnt been paied of, although im sure they wont, but would still prefer a letter saying nothing is owed.
Or will they not bother with that at all?
Regards
