A ticket has been issued from Smart Parking showing 1 minute over the parking ticket, exiting the car park according to their cameras. The parking ticket shows valid until 14:48, and their picture shows the car leaving at 14:49.
Please advise.
Thanks in advance!

Edit your post so the driver cannotbe identified.
Send the template appeal.0 -
Hi. I have received a ticket from Smart Parking as I was 1 minute over my ticket, exiting the car park according to their cameras. I still have my parking ticket showing until 14:48, and their picture shows I left at 14:49.
Should I do anything or should I ignore?
Is there no grace period?!
Thanks in advance!
Is the reason they have sent the NTK an overstay, or is it due to an ANPR mismatch, they may be scammers but one minute over will not fly?0 -

Gilly, what time does their ANPR camera say you arrived?
You need to send the blue text appeal from post #1 of the NEWBIES FAQ sticky thread.
Send it as the keeper.
Send it unchanged - no additions or alterations necessary.0 -
Yes this is within grace periods. BPA Code of Practice (compliance with which is compulsory for members) specifically obliges them to have grace periods, but they are undefined. 60 seconds is quite clearly within a reasonable grace period. The intention of a grace period is to allow a period of time at the start for a person to find a space, park in it, exit the car and read the signs, decide whether or not to accept the terms offered (and queue up and pay if it's a P&D carpark and return to the car to display the ticket), and then at the end time to actually exit the carpark.
It probably took more than a minute for you to drive your car round to the exit and through the exit after leaving the parking space.
Do the template appeal to Smart and then to POPLA. At this stage don't identify driver.
IF you were driving (don't tell us who was) then if, in the unlikely event you don't win at POPLA, you may decide to confirm you were and simply argue that there as no overstay because of the obligation to apply a grace period - ALSO, a 60 second overstay is de minimis with which the court should not be bothered. But that's for later. For now, just use the template appeals. You can argue all of this as RK if you weren't driving.
You need to check, however, that they really are coming at you for a 60 second overstay and that there hasn't been an error with your arrival time, or a double dipping error (where perhaps the car was in the carpark on Saturday and returned on Sunday, but the ANPR thinks the car was there the whole time and has only picked up on one entry and one exit). If it's double dipping then you need to show that you were elsewhere in between the two visits and that it is a case of double dipping.
Put that ticket somewhere safe.
Another option is to go to the landowner, or if it was a retail park to the manager of the shop you went to, to see if they can get it cancelled for you.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. It would be good to know whether it was a shopping centre car park, a hospital car park, a hotel car park, a store car park, etc, and if so, which shopping centre, which hospital, which hotel, etc.
It is extremely unlikely that Smart Parking own the car park.0 -
What was the reason given for issuing the PCN?
What was the time interval between the arrival time according to the PCN and the start time on the P & D ticket. Don't tell us those times, just the time difference. Too much information will identify the driver.
Edit your post as advised to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people.
Once you have done your editing, please read the Sticky thread for NEWBIES then send the appeal template from The Keeper that you will find there.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
On the face of it this will be an easy win at POPLA. Once the ticket is quashed send a complaint to the BPA.0
